Synopsis and List of Dates in Criminal Revision High Court

 

SYNOPSIS

 

The Opposite Party/ Father is not entitle to any maintenance, while the Petitioner/ Son is burdened with the dependents being his Old aged ailing Mother, his Wife, and a little Child, in his much meager earning. The Opposite Party/ Father is earning sufficiently; But with oblique motive claiming maintenance from the Petitioner/ Son, is not desirable.

16-09-2021          -        Misc. Case no. ACM-659 of 2021, application under Section 125 Cr.P.C. filed by the Opposite Party/ Father;

 

02-02-2022          -        The Petitioner appeared in the said Misc. Case;

 

05-07-2022          -        The Order for Interim Maintenance has been passed by the Learned Judicial Magistrate, 4th Court, Alipore, South 24 Parganas, directing your petition to pay a sum of Rs. 4,000/- per month to the Opposite Party/ Father;

 

07-09-2022          -        The Petitioner preferred Criminal Motion being no. 270 of 2002, challenging the said Order dated 05-07-2022, passed in Misc. Case no. ACM-659 of 2021, by the Learned Judicial Magistrate, 4th Court, Alipore, South 24 Parganas;

 

07-09-2022          -        The stay order has been passed by the Learned District Session Judge, Alipore, South 24 Parganas, in Criminal Motion no. 270 of 2022, subject to the payment of Rs. 2,500/- per month;

 

07-10-2023          The Judgment dated 07-10-2023, has been passed by the Learned Additional Session Judge, Alipore, South 24 Parganas, in Criminal Motion no. 270 of 2022, thereby rejecting the criminal motion and affirm the interim maintenance Order dated 05-07-2022, passed in Misc. Case no. ACM-659 of 2021, by the Learned Judicial Magistrate, 4th Court, Alipore, South 24 Parganas;
