Leave and License Agreement
THIS
AGREEMENT is made this day of
November 2013 BETWEEN SRI SRIPATI BHATTACHARJEE son of late Prakash Ch.
Bhattacharjee, by faith- Hindu, by occupation- Retired person, residing at Purbapara,
Laskarpur, P.S. Sonarpur, Kolkata-700153, District on the ground floor
of the building (hereinafter referred to as the LICENSOR which term shall include his successors and assigns) of
the ONE PART
-AND-
SRI ARJUN
KUMAR BHADRA son of late Samir Kumar Bhadra, by faith-Hindu, by occupation-
Service, residing at 5 no. Panna Jhil, Now Para, Barackpur Road, Barasat,
Kolkata-700125(hereinafter referred to as the LICENSEE which term shall include his successors and assigns) of
the OTHER PART.
WHEREAS the LICENSOR is owner of land and
building situated at Purbapara, Laskarpur, P.S. Sonarpur, Holding No.41, Ward
No.29, Kolkata-700153, District -South 24 parganas.
WHEREAS the LICENSEE has requested the
LICENSOR to allow the LICENSEE to occupy and use temporarily about 700 sq.ft.
floor area on the ground floor of the building on leave and license basis for
residential purpose for a period not exceeding 11( Eleven) months only from the
date of signing of this agreement.
AND WHEREAS
the LICENSOR has agreed to allow on leave and license basis the LICENSEE to
occupy and use the said 700 sq.ft. ground floor portion of the said building on
temporary basis.
NOW THESE PRESENTS WITNESSETH and the parties hereby agree as
follows:
1. The LICENSOR hereby allows the
LICENSEE on leave and license basis to use the said 700 sq.ft. area on the
ground floor of the said building situated at Purbapara, Laskarpur, P.S.
Sonarpur, Holding No.41, Ward No.29, Kolkata-700153, District-South 24 Parganas
for residential purpose for a period not exceeding 11(Eleven) months only from
the date of signing of this agreement which the LICENSOR has agreed to grant
reserving for himself the care, maintenance and services to property and on the
basis of leave and license only.
2. This writing shall never be construed
as any tenancy agreement or lease nor otherwise creating any other right or
interest in the property in favour of the LICENSEE which is not at all the
intention of the parties but on the contrary merely a temporary agreement or
arrangement simply to allow the LICENSEE with his family members to use of the
above noted 700 sq.ft. ground floor for their residential
accommodation under the control and supervision of the LICENSOR.
3. The LICENSEE agrees to vacate the
said premises on the expiry of 11(eleven) month or earlier if the LICENSEE
secured an alternative accommodation.
4. The LICENSEE
shall pay to the LICENSOR Rs.5000/- ( Rupees five thousand) only per month as
license fee within 7th day of each succeeding month for which it is
due and payable according to the English Calendar month.
5. That the LICENSEE shall pay a sum of
Rs. 15000/-( Rupees fifteen thousand) only to the LICENSOR herein as an advance
money out of which @ Rs. 1000/-( Rupees one thousand) only shall be adjustable
from the month of December, 2013 ( consecutive 10 months) and the balance Rs.
5000/-( Rupees five thousand) only shall be remain as security money to the
LICENSOR which shall be refunded in cash by LICENSOR ( without any interest) to
the LICENSEE at the time of getting back ground floor( without causing any
damage of floors, grills, doors etc.) in vacant condition from the LICENSEE.
6. That the LICENSEE shall have right to
use the existing meter meant for use of electricity exclusive of the said
ground floor provided it shall pay the electricity charges to the LICENSOR.
7. That it is hereby agreed that the
LICENSEE shall pay regularly on due dates, the electric charges. The LICENSEE
shall maintain the ground floor in good condition and shall not damage any
portion of the same.
8. The license is given on a residential
basis and the LICENSEE will not be entitled to transfer the benefit of this
agreement or give sub-license to anybody else.
9. The LICENSEE undertakes not to cause
any damage or defacement of the ceiling, walls or floors of the licensed
portion.
10.
The LICENSEE shall not carry out any
structural repairs, additions or alteration and shall not cause any nuisance or
annoyance to the neighbours or store any hazardous goods or do anything which
would damage the premises or jeopardize others.
11.
On any breach of any of the terms of the
agreement the LICENSOR will be entitled to terminate the license on giving
seven days’ notice.
12.
On termination of the LICENSE or on expiry of
period of the license the LICENSEE shall make over vacant and peaceful
possession of the licensed portion to the LICENSOR in good condition.
