I, Jayanta Chowdhury, Son of Late Ajay Chowdhury, residing at Premises being No. 44/1A, Shyamnagar Road, Police Station Dum Dum, Kolkata – 700055, Proprietor of M/s. Global Aqua, having its Registered Office at Premises being No. 44/1A, Shyamnagar Road, Police Station Dum Dum, Kolkata – 700055, do hereby solemnly affirm and says as follows;

 

1. That I am being the applicant number 2, herein in the above referred SA application acquainted and conversant with the material facts stated therein. I am Proprietor of M/s. Global Aqua, having its Registered Office at Premises being No. 44/1A, Shyamnagar Road, Police Station Dum Dum, Kolkata – 700055. I am competent to swear this affidavit.

 

2. That the above referred application has been placed in sub section (1) of Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act’ 2002, challenging the possession notice and purported action of the defendant Bank.

 

3. That one IA application no. 2958 of 2024, being Interim Application, praying inter alia an order of injunction restraining the defendants from taking any SARFAESI action against the applicants till the disposal of SA application, and the another IA no. 3106 of 2024, being Put up petition for advance urgent hearing of the said IA application for interim protection from the purported actions of the defendant Bank, has been submitted before the Hon’ble Tribunal.

 

4. That in the above referred SA application, I withdrawn the Vakalatnama of my earlier Learned Advocate Animesh Sanyal, and consequently appointed my new Learned Advocate Ashok Kumar Singh and his Juniors, associated with him by executing Vakalatnama dated 24^th day of August’ 2024.

 

 

 

 

 

 

 

 

5. That my Learned Advocate Ashok Kumar Singh, has taken endavour to cause necessary services of the copies of application including the interim application and the put up petition along with his forwarding Letter dated 24^th day of August’ 2024, upon the defendants Bank.

 

Photostat copy of the forwarding Letter dated 24^th day of August’ 2024, is annexed herewith and marked as Annexure – “A”.

 

6. That I have taken recourses to serve by Speed Post with A/D upon the defendants Bank.

 

Photostat copy of the postal receipts are annexed herewith and marked as Annexure – “B”.

7. That I obtained the Postal Track Report from the Web-portal of the India Post, which shows the complete services on the addressee.
