I,
GobindaSarkar, Son of Late SambhuSarkar, residing at Village Khurigachhi, Post
Office – Sonarpur, Police Station – Naredrapur, District South 24 Parganas, beg
to draw your kind attention for the following facts and circumstances that I am
the owner in respect of the Schedule land and have been in my possession all
along till this day.
I
purchased a plot of Land measuring about 1 (One) Cottah, 08 (Eight) Chhitacks,
30 (Thirty) Square feet, lying and situate at Mouza – Khurigachhi, comrprising
in Dag No. 780, Khatian No. 302, J.L.No. 21, Touzi No. 250, Part No. 40, Post
Office – Sonarpur, Police Station presently at Naredrapur formerly Sonarpur,
District South 24 Parganas, from the legal heirs and successors of the deceased
PachuGopalMandal through their constituted attorney namely Sri Amar Naskar and
Sri BalaiMandal on 19-06-2012, by the Deed of Conveyance duly registered at the
Office of the A.D.S.R. Sonarpur, and it was recorded in Book No. 1, CD Volume
No. 22, From Page No. 6001 to 6014, Being No. 08168 for the year 2012.
While
prepared for purchasing I found that on 30-08-2000, one Compromise petition was
submitted by one Sri NandalalMandal and other in Title Suit No. 99 of 2000 (Sri
Nanda LalMondal and Others – Versus – Sri PanchuGopalMondal), before the
Learned Court of Civil Judge (Senior Division), Baruipur, South 24 Parganas,
which stating the facts that the parties agreed and relied upon mutual
understanding and accordingly the Learned Court endorsed the said compromise
petition as a part of the Decree and accordingly the said suit was disposed of
and in the said compromise petition, the land at Mouza – Khurigachhi,
comprising in Dag No. 780 under Khatian No. 302, measuring 23 decimal was being
awarded to the said deceased PanchuGopalMonbdal and it was affirmed by signing
in the Compromise petition by the parties in the said Suit which decreed on
31-01-2001. Such fact has been established as published in the right of records
by the office of the B.L. & L.R.O. Sonarpur, South 24 Parganas.
The
said PanchuGopalMondal, while peacefully and absolutely seized and possessed,
died intestate in the 07-11-2005, leaving behind his Five Sons, and Three
Daughter, and his wife namely NiromoniMondal, who subsequently died on 21-08-2011.
The Particulars of his Sons are (a) Sri PrabhasMondal, (b) Sri SubhashMondal,
(c) Sri BalaiMondal, (d) Sri BhasanMondal, (e) Sri JibanMondal. The Particulars
of his three daughters are (a) Smt. JamunaSafui, (b) Smt. AbunaSardar, and (c)
Smt. BharatiMondal.
I
beg to say that while I intend to mutate the said land in my name and
accordingly taken the record from your concern where I found the others name in
place of PanchuGopalMondal (now deceased) or his legal heirs, as stated herein
above, and therefore I astonished to see the erroneous record of rights in
respect of the said schedule property.

Development Power of Attorney, dated 07-12-2020, for deliberate non-compliance/
violation of terms of the said Development Agreement and Development Power of
Attorney, dated 07-12-2020, by Letter dated 31st day of January’
2023. My Clients have also asked and remind the said Sri Sumantra Chakraborty,
Son of Sri Chandan Chakraborty, but he did not take the cognizance.
My
Clients further
inform the public at large that not to deal in any arrangement with the said
Sri Sumantra Chakraborty, Son of Sri Chandan Chakraborty, and M/s. Anwesha
Enterprise of his Proprietorship Firm and the same shall not be binding on my
clients. My clients further information the public at large that my clients
shall be at liberty and may proceed to deal with their land property in their
own discretion, through publication of Public Notice at large in daily News
Paper “AAJKAL” circulated in the
State of West Bengal, on 9th day of February’ 2023.
My
Clients did not
take any money from the said Sri Sumantra Chakraborty, Son of Sri Chandan
Chakraborty, and M/s. Anwesha Enterprise of his Proprietorship Firm therefore
there was no money transactions by and between them.

humble petition on behalf of the Appellant most respectfully;
Sheweth as under;
1.
That the
appellant has placed the above referred appeal under Section 29 of the
Protection of Women from Domestic Violence Act’ 2005, challenging the Order
dated 05-06-2024, passed by Learned Chief Judicial Magistrate, Alipore, South
24 Parganas in M.Ex. Case No. 462/2018, inter alia praying for stay of the
operation of the said impugned order. The Learned Court heard the above
referred matter and considered the petition for stay of the impugned Order, and
was pleased to stayed on interim basis the Order dated 05-06-2024, passed by
Learned Chief Judicial Magistrate, Alipore, South 24 Parganas in M. Ex. Case
No. 462/2018, by Order No. 02, dated 02-07-2024.

That the said Order No. 02, dated 02-07-2024, has been placed before
the Learned Chief Judicial Magistrate, Alipore, South 24 Parganas, in M.Ex.
Case No. 462/2018. The Learned Magistrate fixed the date on 03-09-2024, for
further consideration in the said Execution Case.
3.
That the Appellant seeks the extension
of the said Order No. 02,
dated 02-07-2024, staying the operation of the impugned Order dated 05-06-2024,
passed by the Learned Chief Judicial Magistrate, Alipore, South 24 Parganas, in
M.Ex. Case No. 462/2018, till the disposal of the present appeal, in the
interest of administration of Justice.

That unless the Learned Court stay the
operation of the impugned order dated 05-06-2024, passed in M.Ex. no. 462 of
2018, which is pending before the Learned Chief Judicial Magistrate, at
Alipore, South 24 Parganas, till the disposal of the present appeal, the
appellant will highly prejudice and suffer with irreparable loss and injury.
5.
That the balance of convenience and
inconveniences are in favour of the appellants and the respondents will not
prejudice.
6.
That this application is made bona-fide
and for the interest of administration of Justice.
Under the aforesaid facts and circumstances, the
appellant most humbly prays that Your Honour may graciously be pleased to stay
the operation of the impugned Order dated 05-06-2024, passed in M.Ex. No. 462
