MOST RESPECTFULLY SHOWETH;

 

  1. That the present application is being filed on behalf of the accused/petitioner, namely, Ranjit Singh, residing at Kolkata Bajar Road, Nayapara, Sambalpur Sadar, P.O. Sambalpur, District Sambalpur, Odisha – 768001, in connection with the instant complaint case being C.S. No. 359034 of 2026, instituted by the complainant, Aditya Birla Capital Limited.

 

  1. That the instant complaint case has been instituted alleging commission of an offence punishable under Section 25 of the Payment and Settlement Systems Act, 2007, as reflected in the summons issued by this Learned Court.

 

  1. That this Learned Court has been pleased to issue summons upon the accused persons requiring him to appear before this Learned Court on 15.10.2026 at 10:00 a.m. The summons specifically records the direction that the accused persons are required to appear “in person / by pleader” before the Learned 13th Judicial Magistrate at Calcutta.

 

  1. That the accused persons most respectfully submit that the aforesaid expression appearing in the summons itself permits appearance through a pleader/advocate, subject to the discretion and satisfaction of this Learned Court. The accused persons, therefore, seek permission to be represented through their learned advocate, without insisting upon their physical presence on each and every date of hearing.

 

  1. That the accused namely, Ranjit Singh, is a permanent resident of Sambalpur, Odisha, and is carrying on business under the name and style of Janata Trading Co. The accused is presently undergoing medical treatment for his existing health-related difficulties and has been advised medical care and treatment. His medical documents are being annexed to the present application for the kind consideration of this Learned Court.

 

  1. That, owing to his present medical condition and the necessity of continuing medical consultation and treatment, it would cause considerable hardship and inconvenience to accused to undertake repeated long-distance journeys from Sambalpur, Odisha, to Kolkata for the purpose of attending each and every date fixed in the instant proceeding.

 

  1. That the accused person further submit that he is residing at a considerable distance from the jurisdiction of this Learned Court. His repeated physical attendance at Kolkata would entail substantial travelling expenditure, physical inconvenience, disruption of business and domestic responsibilities, and additional hardship, particularly in view of the present medical circumstances of the accused person.

 

  1. That the accused person have the utmost respect for the majesty of law and for the authority and dignity of this Learned Court. He has never intended and do not intend to evade the process of law, avoid the jurisdiction of this Learned Court or cause any unnecessary delay in the disposal of the instant proceeding.

 

  1. That the accused person have duly authorised and engaged Learned Advocate Shri Pritam Das to represent him before this Learned Court in connection with the instant complaint case. The said learned advocate shall appear, act and plead on behalf of the accused persons and shall take all necessary steps for the proper conduct of the proceeding in accordance with law.

 

  1. That the accused person undertake that his learned advocate, Shri Pritam Das, shall remain duly present before this Learned Court on the dates fixed for hearing, subject to the orders and directions of this Learned Court, and shall duly represent the accused person throughout the proceeding, unless otherwise directed.

 

  1. That the accused person further undertake to furnish all necessary instructions, documents and assistance to his learned advocate for the proper and effective conduct of his defence. He shall extend his fullest cooperation for the expeditious disposal of the instant complaint case.

 

  1. That the accused person respectfully submit that the instant proceeding, as reflected from the nature of the summons issued by this Learned Court, is being proceeded with before a Learned Magistrate and is stated by the accused persons to be summary in nature and triable by a Magistrate of the First Class. The accused person submit that, having regard to the nature of the proceeding and the nature of the relief sought herein, his personal attendance on each and every date is not indispensable for the effective progress of the case, subject to the satisfaction of this Learned Court.

 

  1. That the accused person further submit that the summons expressly provides an option to appear “in person / by pleader”. The accused person is, therefore, seeking to avail himself of the said facility by requesting this Learned Court to permit his representation through his learned advocate, particularly in view of his medical conditions and his considerable distance from Kolkata.

 

  1. That the accused person undertake that he shall not dispute or put the complainant to proof of the identity of the accused person in the course of the proceedings, where the same is otherwise legally permissible, and shall remain represented through his learned advocate, Shri Pritam Das.

 

  1. That the accused person further undertake that he shall not unnecessarily object to or dispute the evidence and documents tendered by the complainant during the trial in the presence of his learned advocate, Shri Pritam Das, and shall cooperate with the conduct of the proceeding. Such undertaking is intended to facilitate the expeditious disposal of the matter and shall not be construed as an admission of the allegations contained in the complaint or as a waiver of any substantive or legally protected defence, unless expressly made in accordance with law.

That the accused person undertake that, whenever his personal presence is specifically directed by this Learned Court for any purpose, including recording of plea, identification, examination under the applicable law, or any other purpose where such personal attendance is considered necessary in the interest of justice, he shall appear before this Learned Court on the date so directed, subject to any further order passed by this Learned Court.

 

  1. That the accused person further undertake that he shall not seek unnecessary adjournments and shall not adopt any course of conduct that may impede the expeditious disposal of the instant complaint case.

 

  1. That Section 228 of the Bharatiya Nagarik Suraksha Sanhita, 2023, corresponding to Section 205 of the Code of Criminal Procedure, 1973, empowers the Learned Magistrate, where sufficient reason exists, to dispense with the personal attendance of an accused and permit the accused to appear through an advocate.

 

  1. That the accused person respectfully submit that his present medical difficulties, the considerable distance between Sambalpur and Kolkata, and the engagement of a duly instructed learned advocate constitute sufficient and genuine grounds for consideration of the present application.

 

  1. That the accused person further submit that, in the event that this Learned Court considers it appropriate to proceed with the enquiry or trial in the absence of the accused person while he is represented by his learned advocate, the provisions of Section 355 of the BNSS, 2023, may also kindly be considered, subject to the satisfaction of this Learned Court and the requirements of law.

 

  1. That the accused person is ready and willing to comply with any reasonable terms and conditions that this Learned Court may deem fit and proper to impose while allowing the present application.

 

  1. That no prejudice shall be caused to the complainant or to the proper adjudication of the instant complaint case if the personal attendance of the accused person is dispensed with and he is permitted to be represented through his learned advocate. On the contrary, such an order would avoid unnecessary hardship to the accused person while ensuring the proper and orderly progress of the proceeding.

 

  1. That the present application is being filed bona fide and in the interest of justice, and the accused person pray that the same may kindly be allowed.

 

In the aforesaid facts and circumstances, it is, therefore, most humbly prayed that Your Honour may graciously be pleased to;

 

a) Allow the present application filed under Section 228 of the Bharatiya Nagarik Suraksha Sanhita, 2023, corresponding to Section 205 of the Code of Criminal Procedure, 1973;

 

b) Dispense with the personal attendance of accused Ranjit Singh, in the instant complaint case, having regard to his medical difficulties, the considerable distance from Sambalpur, Odisha, to Kolkata, and the other grounds stated herein;

 

c) Permit the accused person to appear and be represented through his learned advocate, Shri Pritam Das, on all dates of hearing, unless his personal attendance is specifically directed by this Learned Court;

 

d) Pass such further or other order or orders as Your Honour may deem fit and proper in the interest of justice.

 

AND FOR THIS ACT OF KINDNESS, THE ACCUSED PERSONS, AS IN DUTY BOUND, SHALL EVER PRAY.

Judicial authorities regarding permission for passport

Where criminal proceedings are pending, the accused may apply before the concerned criminal court for permission/no objection for issuance or re-issuance of a passport. The applicant should also furnish an affidavit or written undertaking affirming continued participation in the proceedings and appearance before the court whenever required.

Governing provisions

  1. Section 6(2)(f), Passports Act, 1967
    The Passport Authority may refuse issuance of a passport where criminal proceedings against the applicant are pending before a criminal court in India.
  2. Section 22, Passports Act, 1967 read with G.S.R. 570(E), dated 25 August 1993
    The statutory notification creates an exception. A person facing criminal proceedings may obtain a passport upon producing an appropriate order of the concerned court and furnishing a written undertaking to appear before that court whenever required during the validity of the passport.
  3. Office Memorandum dated 10 October 2019
    The applicant must disclose every pending criminal case in the undertaking. Mere registration of an FIR or pendency of investigation, without cognizance by a criminal court, ordinarily does not attract Section 6(2)(f).

The Supreme Court authoritatively held that pendency of criminal proceedings does not create an absolute prohibition against issuance or renewal of a passport. The criminal court may grant permission or no objection after considering the circumstances and securing the applicant’s presence through appropriate conditions.

The applicant is required to furnish an undertaking that he shall appear before the concerned court whenever required. The Court may also direct that the applicant shall not leave India without prior permission. If the court specifies the passport’s validity period, the Passport Authority should honour that period; otherwise, the statutory default provisions may apply.

2. Nausheen Wasim v. State of West Bengal & Others, WPA 25175 of 2024, decided on 28 November 2024, Calcutta High Court

The Calcutta High Court observed that if an applicant undertakes to cooperate with the trial and remain available whenever required by the criminal court, there is ordinarily no reason to refuse permission to travel abroad unless genuine circumstances indicate a risk of abscondence.

The Court recognised the relevance of an undertaking specifying the period of foreign travel and the date within which the applicant would return to India.

3. Vangala Kasturi Rangacharyulu v. Central Bureau of Investigation, 2020 Criminal Law Journal (SC) 572

The Supreme Court held that Section 6(2)(f) concerns criminal proceedings pending before a trial court. Pendency of a criminal appeal, by itself, cannot automatically justify refusal to renew a passport. The decision supports the proposition that passport restrictions must be applied according to the exact statutory conditions and not mechanically.

আমার মনে পড়ে, আলিপুর পুলিশ কোর্টে একজনের সঙ্গে আমার পরিচয় হয়েছিল। শুনেছিলাম, তাঁর রাজনৈতিক জীবনের একসময় তিনি সিপিএমের সঙ্গে যুক্ত ছিলেন। পরবর্তীকালে তাঁর সঙ্গে যখন আমার পরিচয় হয়, তখন তিনি বিজেপির রাজনীতির সঙ্গে যুক্ত ছিলেন বলে জানতাম।

তবে রাজনৈতিক সংগঠনের অভ্যন্তরে তাঁর অবস্থান, গ্রহণযোগ্যতা কিংবা প্রভাব কতটা ছিল, সে বিষয়ে আমার ব্যক্তিগত ধারণা স্পষ্ট নয়। রাজনীতির অন্দরমহলে কে কতটা গ্রহণযোগ্য, কে কতটা উপেক্ষিত—সেই হিসাব বাইরে থেকে করা সব সময় সম্ভব হয় না।

তবু সময়ের সঙ্গে সঙ্গে তাঁর কর্মকাণ্ডের পরিধি আমার চোখে ক্রমশ বিস্তৃত হতে থাকে।

হাওড়া আদালতের ঘটনা এবং আন্দোলনের ময়দানে আত্মপ্রকাশ

আমার মনে পড়ে, হাওড়া আদালতে একটি ঘটনাকে কেন্দ্র করে পুলিশ ও আইনজীবীদের মধ্যে উত্তেজনা সৃষ্টি হয়েছিল। আইনজীবীদের ওপর লাঠিচার্জ এবং পুলিশের আচরণ নিয়ে আইনজীবী মহলে প্রবল ক্ষোভের সৃষ্টি হয়। ঘটনাটি নিয়ে আইনজীবী সমাজে আলোড়ন তৈরি হয়েছিল।

সেই সময় তিনি সক্রিয়ভাবে সামনে এগিয়ে আসেন। নিজেকে ঘটনাটির একজন ভুক্তভোগী কিংবা আইনজীবী সমাজের একজন প্রতিনিধি হিসেবে তুলে ধরে আন্দোলনের ময়দানে তাঁর উপস্থিতি জানান দেন।

একজন আইনজীবী যখন সহকর্মীদের অধিকারের প্রশ্নে সরব হন, তখন তাঁর ভূমিকা নিঃসন্দেহে গুরুত্বপূর্ণ হয়ে উঠতে পারে। কিন্তু সেই ভূমিকার প্রকৃত মূল্যায়ন নির্ভর করে আন্দোলনের উদ্দেশ্য, ধারাবাহিকতা, বাস্তব অবদান এবং ফলাফলের ওপর।

শুধু আবেগ, বক্তৃতা কিংবা জনসমক্ষে উপস্থিতি দিয়ে কোনো আন্দোলনের সাফল্য বিচার করা যায় না।

আইনজীবীদের ত্রাতা হওয়ার আকাঙ্ক্ষা

আমার মনে হয়েছিল, তিনি ধীরে ধীরে আইনজীবীদের একজন সর্বক্ষণের অভিভাবক হয়ে ওঠার চেষ্টা করছেন। কোনো আইনজীবী সমস্যায় পড়েছেন, কেউ পুলিশের হাতে আক্রান্ত হয়েছেন, কেউ পেশাগত সংকটে রয়েছেন—এই ধরনের ঘটনায় তিনি সামনে আসতে চাইতেন।

আইনজীবীদের জন্য একটি সংগঠন প্রতিষ্ঠার উদ্যোগও তিনি নিয়েছিলেন বলে আমার মনে পড়ে। তাঁর বক্তব্য ছিল, আইনজীবীদের স্বার্থরক্ষায় তিনি সর্বদা পাশে থাকবেন।

একজন আইনজীবীর বিপদে আরেকজন আইনজীবী এগিয়ে আসবেন—এটি অবশ্যই পেশাগত সংহতির একটি গুরুত্বপূর্ণ দৃষ্টান্ত। কিন্তু একজন মানুষের প্রকৃত মূল্যায়ন হওয়া উচিত তাঁর কাজের মাধ্যমে, নিজের সম্পর্কে তাঁর প্রচারের মাধ্যমে নয়।

কেউ নিজেকে আইনজীবী সমাজের ‘সুপারম্যান’ হিসেবে প্রতিষ্ঠিত করতে চাইতেই পারেন। কিন্তু প্রকৃত প্রশ্ন হলো—সেই নায়কোচিত পরিচয়ের আড়ালে বাস্তব কাজ কতটা রয়েছে?

বার কাউন্সিল নির্বাচন এবং জনপ্রিয়তার রাজনীতি

আমার মনে হয়েছিল, আইনজীবীদের মধ্যে জনপ্রিয়তা অর্জনের এই প্রচেষ্টার সঙ্গে ভবিষ্যতে বার কাউন্সিলের নির্বাচনে অংশগ্রহণের আকাঙ্ক্ষাও যুক্ত থাকতে পারে।

নির্বাচনী রাজনীতিতে পরিচিতি, জনসংযোগ এবং সহকর্মীদের সমর্থন গুরুত্বপূর্ণ ভূমিকা পালন করে। একজন প্রার্থী তাঁর সামাজিক ও পেশাগত কর্মকাণ্ডের মাধ্যমে সমর্থন অর্জন করতে পারেন। তবে কোনো ব্যক্তির রাজনৈতিক দলীয় সমর্থন, মনোনয়ন পাওয়ার সম্ভাবনা কিংবা সংগঠনের অভ্যন্তরে অবস্থান সম্পর্কে নিশ্চিত মন্তব্য করার আগে নির্ভরযোগ্য তথ্য থাকা প্রয়োজন।

বার কাউন্সিলের নির্বাচন প্রতিদ্বন্দ্বিতা করার অধিকার প্রত্যেক যোগ্য আইনজীবীর রয়েছে। সেখানে জয়-পরাজয় গণতান্ত্রিক প্রক্রিয়ারই অংশ। নির্বাচনে পরাজয় কোনো মানুষের সমস্ত পেশাগত পরিচয়কে মুছে দেয় না, আবার নির্বাচনী সাফল্যও কারও আইনজ্ঞান বা পেশাগত দক্ষতার চূড়ান্ত প্রমাণ নয়।

বই লেখা, গান, আবৃত্তি এবং বহুমুখী প্রতিভা

আমার মনে পড়ে, তিনি একাধিক বই লিখেছেন বলে পরিচিত ছিলেন। গান করেন, আবৃত্তি করেন, লেখালেখি করেন, এমনকি গোয়েন্দা কাহিনি রচনার সঙ্গেও যুক্ত রয়েছেন—এমন নানা পরিচয় তাঁর সম্পর্কে শুনেছি।

একজন মানুষের মধ্যে যদি আইনচর্চার পাশাপাশি সাহিত্য, সংগীত, আবৃত্তি এবং সৃজনশীলতার প্রতি আগ্রহ থাকে, তাহলে সেটি অবশ্যই প্রশংসনীয়।

তবে সাহিত্যকর্মের ক্ষেত্রে মৌলিকতা, উৎসের স্বীকৃতি এবং অন্যের সৃষ্টির প্রতি সম্মান অত্যন্ত গুরুত্বপূর্ণ। কোনো লেখার বিরুদ্ধে নকল বা অননুমোদিত ব্যবহারের অভিযোগ থাকলে তা যাচাইযোগ্য প্রমাণের ভিত্তিতে আলোচনা করা উচিত। প্রমাণ ছাড়া কাউকে সাহিত্যচৌর্যের জন্য অভিযুক্ত করা ন্যায়সংগত নয়।

সৃষ্টিশীলতার জগতে প্রকৃত কৃতিত্বের মূল্য নির্ধারিত হয় মৌলিক চিন্তা, পরিশ্রম এবং সততার মাধ্যমে।

আইনজীবী থেকে সরকারি কৌঁসুলি—পরিচয়ের পরিবর্তন

সময়ের সঙ্গে সঙ্গে তাঁর পেশাগত পরিচয়েও পরিবর্তন এসেছে বলে আমার মনে পড়ে। একসময় যাঁকে আন্দোলনের ময়দানে সক্রিয় বলে দেখা যেত, পরবর্তীকালে তাঁকে সরকারি কৌঁসুলির ভূমিকায় দেখা গেছে।

সরকারি কৌঁসুলি হিসেবে দায়িত্ব পাওয়া একটি গুরুত্বপূর্ণ পেশাগত দায়িত্ব। এই দায়িত্বের সঙ্গে যুক্ত থাকে রাষ্ট্রের পক্ষে আদালতে মামলা পরিচালনা, সাক্ষ্য-প্রমাণ উপস্থাপন, আইনের যথাযথ প্রয়োগ এবং ন্যায়বিচার নিশ্চিত করার সাংবিধানিক ও পেশাগত কর্তব্য।

কোনো সরকারি কৌঁসুলির দক্ষতা নির্ধারিত হয় তাঁর রাজনৈতিক পরিচয়, সামাজিক জনপ্রিয়তা কিংবা প্রচারের মাত্রা দিয়ে নয়। তাঁর দক্ষতা যাচাই করতে হলে দেখতে হবে—তিনি মামলার নথি কতটা জানেন, আইনের ব্যাখ্যা কতটা সঠিকভাবে উপস্থাপন করেন, সাক্ষীদের জেরা কতটা কার্যকরভাবে পরিচালনা করেন এবং আদালতের সামনে কতটা দায়িত্বশীল ভূমিকা পালন করেন।

একজন কৌঁসুলি কতগুলি মামলা পেয়েছেন, সেটি একটি তথ্য হতে পারে। কিন্তু তিনি সেই মামলাগুলিতে কী কাজ করেছেন, সেটিই প্রকৃত মূল্যায়নের বিষয়।

আইনজীবীর পোশাক, কথাবার্তা এবং পেশাগত পরিচয়

অনেক সময় মানুষের পোশাক-পরিচ্ছদ, কথাবার্তা কিংবা সামাজিক আচার-আচরণ দেখে আমরা তাঁর পেশাগত যোগ্যতা সম্পর্কে ধারণা তৈরি করি। কিন্তু আদালতের পেশায় বাহ্যিক পরিচয় কখনোই দক্ষতার নির্ভরযোগ্য মাপকাঠি হতে পারে না।

একজন আইনজীবী খুব বেশি কথা বলতে পারেন, আবার কেউ অত্যন্ত সংযত হতে পারেন। কেউ আদালতের বাইরে প্রাণবন্ত আড্ডাবাজ, আবার কেউ নীরব ও অন্তর্মুখী। এই বৈচিত্র্য পেশাগত জীবনের স্বাভাবিক অংশ।

প্রকৃত প্রশ্ন হলো—তিনি আদালতে কেমন প্রস্তুতি নিয়ে আসেন, আইন কতটা বোঝেন, নথি কতটা পড়েন এবং বিচারপ্রক্রিয়ায় তাঁর অবদান কতটা কার্যকর।

একজন আইনজীবীর পরিচয় তাঁর গাউন, তাঁর পদবি কিংবা তাঁর প্রচার নয়; তাঁর প্রকৃত পরিচয় তাঁর পেশাগত কাজের মানে।

একজন মানুষের মধ্যে এত প্রতিভা—সত্যিই বিস্ময়কর!

আমার মনে হয়, ওই মানুষটির মধ্যে বহু ধরনের প্রতিভার প্রকাশ ঘটেছে। তিনি সংগঠন করতে চান, আন্দোলন করতে চান, গান করেন, আবৃত্তি করেন, বই লেখেন, সাহিত্যচর্চা করেন এবং আইনচর্চার সঙ্গেও যুক্ত রয়েছেন।

একজন মানুষ একই সঙ্গে এতগুলি ক্ষেত্রে নিজেকে প্রকাশ করতে চাইছেন—এটি নিঃসন্দেহে একটি লক্ষণীয় বিষয়।

তাঁর পরিবার, তাঁর স্ত্রী, তাঁর সন্তান এবং তাঁর ব্যক্তিগত জীবনের নানা পরিচয়ও হয়তো তাঁর কাছে গর্বের বিষয়। একজন মানুষ তাঁর জীবনে নানা সাফল্য নিয়ে গর্বিত হতেই পারেন।

তবে ব্যক্তিগত গর্ব ও পেশাগত কৃতিত্ব—এই দুইয়ের মধ্যে একটি সুস্পষ্ট পার্থক্য রয়েছে।

আমরা যদি সত্যিই পেশাকে ভালোবাসি, তাহলে ব্যক্তিকে নয়, তাঁর কাজকে মূল্যায়ন করব।

আইনজ্ঞান ও আদালতের বাস্তব পরীক্ষা

আমার মনে পড়ে, কখনো কখনো এমন পরিস্থিতি তৈরি হয়, যখন একজন আইনজীবীর প্রকৃত আইনজ্ঞান নিয়ে প্রশ্ন ওঠে। বিশেষ করে, যখন কোনো আইনজীবী একটি নির্দিষ্ট আইনি আবেদনের কাঠামো, সংশ্লিষ্ট বিধান কিংবা প্রক্রিয়াগত বিষয় নিয়ে অসুবিধায় পড়েন, তখন তাঁর প্রস্তুতি সম্পর্কে আলোচনা হতে পারে।

তবে কোনো নির্দিষ্ট আইনজীবী কোনো particular আবেদন লিখতে পারেন না—এমন দাবি করার আগে সংশ্লিষ্ট নথি, তাঁর বক্তব্য এবং বাস্তব পরিস্থিতি যাচাই করা উচিত।

একজন আইনজীবী সব বিষয়ে সমান পারদর্শী হবেন, এমন কোনো নিয়ম নেই। আইন একটি বিস্তৃত ও জটিল বিষয়। একজন আইনজীবী কোনো ক্ষেত্রে দুর্বল হতে পারেন, আবার অন্য কোনো ক্ষেত্রে অত্যন্ত দক্ষ হতে পারেন।

সুতরাং আইনজীবীর পেশাগত উন্নতির জন্য আত্মসমালোচনা, নিয়মিত অধ্যয়ন, অভিজ্ঞ সহকর্মীদের সহযোগিতা এবং আদালতের বাস্তব অভিজ্ঞতা অত্যন্ত গুরুত্বপূর্ণ।

সরকারি কৌঁসুলির সাফল্য বিচার হবে আদালতের রায়ে

কোনো সরকারি কৌঁসুলি একটি মামলায় সাফল্য অর্জন করবেন কি না, তা আগে থেকে নিশ্চিতভাবে বলা যায় না। আদালতের রায় নির্ভর করে সাক্ষ্য-প্রমাণ, নথিপত্র, আইনের ব্যাখ্যা এবং বিচারকের স্বাধীন মূল্যায়নের ওপর।

কোনো মামলায় দোষসিদ্ধি হলে সেটিকে কেবল কৌঁসুলির ব্যক্তিগত কৃতিত্ব হিসেবে দেখা যেমন সঠিক নয়, তেমনই খালাস হলে সমস্ত দায় কৌঁসুলির ওপর চাপিয়ে দেওয়াও ন্যায়সংগত নয়।

বিচারব্যবস্থার মূলনীতি হলো—অভিযোগ প্রমাণের দায় রাষ্ট্রপক্ষের, আর বিচারকের সিদ্ধান্ত নির্ভর করবে আইনসম্মত প্রমাণের ওপর।

সুতরাং কোনো সরকারি কৌঁসুলির প্রকৃত মূল্যায়ন করতে হলে তাঁর মামলার প্রস্তুতি, আইনি যুক্তি, পেশাগত আচরণ এবং আদালতের প্রতি দায়বদ্ধতা বিচার করা প্রয়োজন।

শেষ কথা—সময়ই প্রকৃত মূল্যায়ন করবে

আমার মনে পড়ে, সেই মানুষটির জীবনে কতগুলি পরিচয় এসেছে, কতগুলি ভূমিকা তিনি গ্রহণ করেছেন, কতগুলি স্বপ্ন তিনি দেখেছেন এবং কতগুলি ক্ষেত্রে নিজেকে প্রতিষ্ঠিত করার চেষ্টা করেছেন।

সময় পরিবর্তনশীল। মানুষের পরিচয়ও পরিবর্তিত হয়। কেউ আন্দোলনকারী থেকে সরকারি কৌঁসুলি হন, কেউ লেখক থেকে আইনজীবী হন, কেউ সংগঠক থেকে প্রশাসনিক দায়িত্বে আসেন। এই পরিবর্তন জীবনের স্বাভাবিক গতিপথের অংশ।

কিন্তু প্রতিটি নতুন পরিচয়ের সঙ্গে নতুন দায়িত্বও আসে।

আইনজীবী হিসেবে পরিচিতি পাওয়া এক বিষয়, আর প্রকৃত অর্থে আইনজীবীর পেশাগত মর্যাদা অর্জন করা সম্পূর্ণ ভিন্ন বিষয়।

পদ পাওয়া যায়, দায়িত্ব পাওয়া যায়, পরিচিতি পাওয়া যায়—কিন্তু পেশাগত সম্মান অর্জন করতে হয় দীর্ঘদিনের সততা, অধ্যবসায়, আইনজ্ঞান এবং ন্যায়বোধের মাধ্যমে।

কেউ কতটা জানেন, কতটা পারেন, কতটা পারেন না—তার চূড়ান্ত বিচার হয় আদালতের নথিতে, যুক্তিতর্কে, পেশাগত আচরণে এবং সময়ের পরীক্ষায়।

তাই আজ কোনো ব্যক্তির নাম না নিয়েই শুধু এটুকু বলি—

“পরিচয় যতই পরিবর্তিত হোক, পদ যতই উন্নীত হোক, প্রতিভার প্রকাশ যতই বহুমুখী হোক, একজন আইনজীবীর প্রকৃত মর্যাদা নির্ধারিত হয় তাঁর পেশাগত সততা, আইনের প্রতি শ্রদ্ধা এবং ন্যায়বিচারের প্রতি অবিচল অঙ্গীকারের মাধ্যমে।”

সময় এগিয়ে চলেছে। আদালত চলছে। মামলা চলছে। যুক্তি উপস্থাপিত হচ্ছে। রায় লেখা হচ্ছে। আর আমরা যারা আইনজগতের সঙ্গে যুক্ত, তারা প্রত্যেকেই সময়ের সাক্ষী হয়ে দেখছি—কে কীভাবে নিজের পেশাগত পরিচয় নির্মাণ করছেন।

দেখে যাব। শিখে যাব। মূল্যায়নও হবে—তবে তা হবে কাজের ভিত্তিতে, ব্যক্তিগত বিদ্বেষের ভিত্তিতে নয়।
