In reference to your Memo No. 2261/DLC/JAL/2025 dated 27.09.2025, convening a joint conference on 10.10.2025 at 12:30 PM in connection with the above matter, the Management of Nuddea Plantations Limited, owner of Totapara Tea Estate, most respectfully submits herewith its written representation for consideration during the conciliation proceedings;

 

1.      The representation is being filed in compliance with the Hon’ble High Court’s Order dated 25.09.2025, whereby the Hon’ble Court was pleased to direct the Petitioner Company to pay interim bonus @ 9% by 27.09.2025 and to participate in conciliation under the Industrial Disputes Act, 1947 and the Payment of Bonus Act, 1965 for settlement of the balance claim, if any.

 

2. The Management has already disbursed the interim bonus @ 9% to all eligible workmen within the stipulated time, and documentary evidence in support of such payment is enclosed herewith.

 

3. The representation, along with supporting enclosures, sets out the Company’s financial position, compliance status, and legal submissions under Sections 10 and 11 of the Payment of Bonus Act, 1965, supported by relevant judicial precedents.

 

You are therefore requested to kindly acknowledge receipt of the same and take on record the Management’s compliance and bona fide submissions during the conciliation meeting scheduled for today.
