Undertaking to appear by next date of hearing;

 

The humble Petition on behalf of the above named accused person, most respectfully;

Sheweth as under ;

 

1.   That the accused person is in receipt of the summon, issued by the Learned Court on taking cognizance for the alleged offence punishable under Section 138, 141 of the Negotiable Instrument Act, 1881.

 

2.   That the accused no. 3, Saroj Devi, could not appear before the Learned Court due her serious illness.

 

3.   That the Learned Advocate, who received such communication of the accused no.3, Saroj Devi, undertake to place Vakalatnama, and take necessary endavour to place in person the accused no. 3, Saroj Devi, by the next date of hearing in the present criminal case, before the Learned Court.

 

4.   That this application is made bonafide and in the interest of administration of Justice.

It is therefore prayed that your Honour would graciously be pleased to allow this petition and to take the undertaking of the Learned Advocate on behalf of the accused no. 3, Saroj Devi, in the interest of administration of Justice, and or to pass such other necessary order or orders, as your Honour may deem, fit and proper for the end of Justice.

 

And for this act of kindness, the Petitioner as in duty bound shall ever pray.
