Criminal Complaint against Shri Joynarayan M. Kesh, Smt. Trishna Kesh and Shri Bibek Ranjan Kesh for offences being cheating, criminal breach of trust, extortion, criminal intimidation, and criminal conspiracy

Subject: Criminal Complaint against Shri Joynarayan M. Kesh, Smt. Trishna Kesh and Shri Bibek Ranjan Kesh for offences being cheating, criminal breach of trust, extortion, criminal intimidation, and criminal conspiracy.

 

Respected Sir,

 

I, Avijit Adhikari, son of Late Amit Adhikari, residing at premises being No. 32, Goswami Para, Joka, Kolkata – 700104, District South 24 Parganas, along with my wife Mrs. Barna Chakraborty Adhikari, most respectfully submit this complaint seeking immediate intervention of your office in connection with the unlawful, dishonest and threatening activities of the accused persons named herein below.

 

  1. Shri Joynarayan M. Kesh, resident of Village Malandighi, Post Malandighi, P.S. Burdwan Pond, District Burdwan, West Bengal – 713101, Mobile No. +91 8609096154.
  2. Smt. Trishna Kesh, wife of Shri Joynarayan M. Kesh, residing at the same address.
  3. Shri Bibek Ranjan Kesh, son of Shri Joynarayan M. Kesh, residing at 247 Nehru Avenue, C-Zone, Durgapur Municipal Corporation – 713205, Mobile No. +91 7063608483.

These three persons are hereinafter collectively referred to as the accused persons.

 

1. The complainant and his wife were formerly employed as faculty members in a reputed educational institution, namely RICE Education, at Kolkata. During their tenure at RICE, Shri Bibek Ranjan Kesh was a student under their guidance and maintained a cordial relationship with both complainants.

 

2. In the year 2023, after resigning from RICE Education, the complainant and his wife started their own coaching centre for competitive examinations at a rented premises in Kolkata. At that time, due to the new establishment’s initial capital requirements, the complainants were in urgent need of financial assistance to develop the said coaching institute.

 

3. Taking advantage of such financial need, Shri Bibek Ranjan Kesh approached the complainants and proposed to arrange certain financial help from his family members, namely his father Shri Joynarayan M. Kesh and mother Smt. Trishna Kesh, as a friendly and interest-free assistance for a short duration, assuring that no risk or condition would be attached.

 

4. Relying upon such representations, the complainants accepted the offer in good faith. Thereafter, on 16 October 2023, a sum of 5,00,000 (Rupees Five Lakhs) was paid in cash to the complainants by Shri Bibek Ranjan Kesh. On 18 October 2023, a further sum of 9,50,000 (Rupees Nine Lakhs Fifty Thousand) was transferred through bank account from Shri Joynarayan M. Kesh, and another 10,50,000 (Rupees Ten Lakhs Fifty Thousand) was transferred from the bank account of Smt. Trishna Kesh to the account of Mrs. Barna Chakraborty Adhikari.

 

5. Thus, the total financial assistance received amounted to 25,00,000 (Rupees Twenty-Five Lakhs only). An acknowledgment in respect thereof was executed on a Non-Judicial Stamp Paper at the insistence of the accused persons, under the assurance that the said document was a mere record of the financial assistance.

 

6. At that time, the accused persons further insisted on keeping certain original documents and personal belongings of the complainants as “security,” assuring that the same would be returned upon repayment of the money. Trusting them, the complainants handed over:
(a) The Original Deed of Conveyance being No. I-3823 of 2020 dated 14 March 2020 relating to the complainants’ immovable property measuring about 3 (three) Cottahs more or less;
(b) The Original Passport of Shri Avijit Adhikari bearing Passport No. W7413494 and the Original Passport of Mrs. Barna Chakraborty Adhikari bearing Passport No. W8637741; and
(c) Several undated cheques drawn on the complainants’ bank accounts as additional security.

 

7. These documents were taken by the accused persons under the guise of good faith and mutual trust, without any legal or enforceable loan agreement specifying terms of repayment, interest, or mortgage.

 

8. After a few months, due to unavoidable business competition and financial constraints, the coaching centre could not sustain, resulting in severe loss and financial hardship for the complainants. Taking undue advantage of this situation, the accused persons began to demand that the complainants execute a Deed of Conveyance of their said immovable property in favour of Shri Joynarayan M. Kesh and his family.

 

9. The complainants were shocked to find that the accused persons, who had initially portrayed themselves as benevolent financiers, had turned coercive and threatening. They repeatedly visited the complainants’ residence with associates and bouncers, issuing verbal threats that unless the property was transferred and possession handed over, they would lodge a false criminal case at Durgapur to “teach a lesson.”

 

10. The said property presently has a market valuation of approximately 80 Lakhs or more, whereas the accused persons had advanced only 25 Lakhs in total. Their insistence on acquiring ownership and possession of such a valuable asset for a paltry amount clearly demonstrates their dishonest and fraudulent intention from the very inception.

 

11. The accused persons have also refused to return the original property deed, the passports, and the undated cheques, despite repeated requests, thereby causing wrongful loss and continuous mental harassment to the complainants. The acts of taking and retaining these documents amount to criminal breach of trust and misappropriation.

 

12. The continuous threats, coercion, and unlawful demand for transfer of property amount to the offences of cheating, criminal breach of trust, extortion, criminal intimidation, and criminal conspiracy. The conduct of the accused persons also indicates preparation and attempt to unlawfully dispossess the complainants of their lawful property.

Prayer for Police Action

 

13. In view of the aforesaid facts and circumstances, I most humbly request you to:

(a) Register a First Information Report (FIR) against the said accused persons under the appropriate sections of the BNS, 2023;


(b) Investigate the entire matter thoroughly to recover the original deed, passports and cheques wrongfully retained by the accused;


(c) Prevent any attempt on their part to unlawfully dispossess the complainants or forcibly occupy their residential property;

 and
(d) Ensure protection of the complainants’ life, liberty and property from continuous threats and intimidation by the accused and their associates.

 

14. The complainants are ready and willing to furnish all necessary evidence, including:

  • Copies of bank transfer details showing receipt of 9.5 Lakhs and 10.5 Lakhs from the accounts of Joynarayan M. Kesh and Trishna Kesh respectively;
  • The copy of acknowledgment executed on Non-Judicial Stamp Paper;
  • Statements of witnesses present during the transaction; and
  • Call records and messages evidencing threats and intimidation.

 

15. The unlawful acts of the accused persons have caused immense mental agony and financial distress to the complainants and have created a grave sense of insecurity. Immediate intervention of the police is therefore necessary to ensure justice and to prevent further harassment or criminal acts by the accused persons.
