Subject : Legal Notice for Compliance of the Order & Judgment dated 11/06/2025, passed in SC/19/CC/263/2020, by the Hon'ble State Consumer Disputes Redressal Commission, West Bengal;

 

My Client : Shri Sanjib Das, Son of Late Sankar Chandra Das, residing at Premises No. Block – E6, Tagore Park, Ward No. 10, Kolkata – 700039, District South 24 Parganas, West Bengal.

 

Dear Sir/s, Madam/s,

 

Under instructions and on behalf of my client, Shri Sanjib Das, Son of Late Sankar Chandra Das, residing at Premises No. Block – E6, Tagore Park, Ward No. 10, Kolkata – 700039, District South 24 Parganas, West Bengal, Decree Holder in the matter referred hereinbelow, I hereby issue this Legal Notice as follows;

 

  1. That my client was the Complainant in Consumer Case No. SC/19/CC/263/2020 (Shri Sanjib Das – Versus – M/s. Riverbank Developers Private Limited & Anr.), which was finally adjudicated by the Hon’ble State Consumer Disputes Redressal Commission, West Bengal.

 

  1. That by a final Order & Judgment dated 11.06.2025, the Hon’ble State Commission was pleased to allow the said Consumer Complaint ex-parte against you, the Opposite Parties / Judgment Debtors, and directed you jointly and severally as follows;

 

(i)   To refund a sum of Rs. 24,22,603/- (Rupees Twenty Four Lakhs Twenty Two Thousand Six Hundred Three) only to my client;

 

(ii)  To pay Rs. 50,000/- (Rupees Fifty Thousand) only towards compensation;

 

(iii)                To pay Rs. 30,000/- (Rupees Thirty Thousand) only towards litigation cost;

 

(iv) All within a period of one month from the date of the order, failing which the refundable amount and compensation amount shall carry interest @ 7% per annum till realization in full.

 

 

 

  1. That the said Consumer Case was decided ex-parte, since despite entering appearance and filing Written Versions, you deliberately failed to participate in the trial of the said case, compelling the Hon’ble State Commission to proceed and decide the matter against you.

 

  1. That subsequently, it was noticed that the Order & Judgment dated 11.06.2025 contained certain typographical errors relating to the sum directed to be refunded. Accordingly, my client filed a Review Application being SC/19/RA/20/2025, arising out of SC/19/CC/263/2020.

 

  1. That the Hon’ble State Consumer Disputes Redressal Commission, West Bengal, by Order No. 17 dated 09.10.2025, was pleased to allow the said Review Application and directed correction of the said typographical errors, thereby finally settling and clarifying the amounts payable by you in terms of the original order.

 

  1. That a substantial period has elapsed since the passing of the Order & Judgment dated 11.06.2025, as also after the correction order dated 09.10.2025, and despite having due knowledge thereof, you have failed, neglected and refused to comply with the lawful directions of the Hon’ble State Commission till date.

 

  1. That your continued non-compliance is willful, deliberate and contumacious, rendering you liable to face execution proceedings and coercive measures under the provisions of the Consumer Protection Act, 2019, entirely at your own risk as to costs and consequences.

 

 

 

 

 

 

 

Therefore, through this Legal Notice, you are hereby finally called upon and required to comply with the Order & Judgment dated 11.06.2025, as corrected by Order No. 17 dated 09.10.2025, passed in SC/19/CC/263/2020, by paying the entire decretal amount along with applicable interest, within a period of 15 (fifteen) days from the date of receipt of this notice.

 

Take further notice that in the event of your failure to comply within the aforesaid period, my client shall be constrained to initiate appropriate execution proceedings and all other remedies available in law before the Hon’ble State Consumer Disputes Redressal Commission, West Bengal, without any further reference to you, and you shall be solely responsible for all resultant costs, interest and legal consequences.

 

A copy of this notice is retained in my office for future reference.
