Smt. Mina Basu issued a legal notice through her Advocate cancelling the Development Agreement due to non-performance by the developer.

Title Suit No. 14 of 2008 filed by M/s. Skylark Construction and its partners against Smt. Mina Basu before the Learned Civil Judge (Senior Division), Alipore, South 24 Parganas.

20.08.2010

 

Title Suit No. 14 of 2008 dismissed on contest by the Learned 5th Court of Civil Judge (Senior Division), Alipore, holding against the developers.

 

2011 (Early)

 

Appeal preferred by the plaintiffs being F.A. No. 46 of 2011 before the Hon’ble High Court at Calcutta.

Hon’ble High Court at Calcutta dismissed F.A. No. 46 of 2011, thereby affirming the judgment dated 20.08.2010.

2011 onwards

 

Judgment in Title Suit No. 14 of 2008 attained finality; no agreement or contractual right survived in law.

2021

 

Present Consumer Complaint No. CC/06/2021 filed by Sri Paramartha Choudhury before the Hon’ble District Consumer Disputes Redressal Commission, Kolkata Unit-III.

2023

 

Opposite Party No. 1 filed Written Version and Evidence on Affidavit denying all allegations and raising objections of maintainability, limitation, and lack of consumer relationship.
