PETITION
The humble petition of the
above named Judgment Debtor Sri Subal Chandra Saha, most respectfully;
Sheweth
as under :
1.
That
in the above referred case matter, the Hon’ble Forum has issued Warrant of
Arrest against the Judgment Debtor, and whereas the Judgment Debtor was in
Nursing Home for his treatment related to heart attack sufferings and others,
and for such reasons alone Police did not arrest the judgment debtor, and
suggest to surrender before the Hon’ble Forum.
2.
That
the Judgment Debtor is coming before the Hon’ble Forum, today, and surrendering
himself before the Hon’ble Forum, with a prayer for release on Bail, as such
the Judgment Debtor is still under treatment and not able to move from bed.
3.
That
since the Judgment Debtor was under prolong treatment of his heart attack and
other related ailments, and admitted time to time in nursing home and hospitals
for his treatment, and thus the judgment debtor was not in a position to lead
his normal life and as such the circumstances was beyond the control of the
judgment debtor.
4.
That
the Judgment Debtor was not in receipt of any notices and or summons issued by
the Hon’ble Forum.
5.
That
this is the Police, wherefrom the Judgment Debtor came to know about the
Warrant of Arrest issued by the Hon’ble Forum.
6.
That
the Judgment Debtor is a peace loving and law abiding Citizen, residing
permanently at the address as premises no. 50, Jiban Mohini Ghosh Park,
Haridevpur, Kolkata – 700 082, District – South 24 Parganas, which is well fall
under the jurisdiction of the Hon’ble Forum.
7.
That
in view of such facts and circumstances, the Judgment Debtor seeks to release
on Bail at any terms and conditions as determined and ascertained by the
Hon’ble Forum, in the interest of administration of justice.
8.
That
the Judgment Debtor undertake to comply with all the legal formalities as
ascertained by the Hon’ble Forum, in the interest of administration of justice.
9.
That
unless the Hon’ble Forum release the judgment Debtor on Bail, he will be highly
prejudice and suffer with irreparable loss and injury.
10.
That
this application is made bonafide in the interest of administration of justice.
It is therefore, prayed that
your Honour would be graciously pleased to allow this application and to grant
Bail at any terms and conditions to the Judgment
Debtor, in the interest of administration of justice, and or to pass such other
necessary order or orders as your Honour may deem, fit and proper for the end
of justice.
And
for this act of kindness, the Petitioner, as in duty bound shall ever pray.
Verification
I,
Sri Subal Chandra Saha, being the Judgment Debtor in the above referred case
matter, made this application and I am conversant with the material facts as
stated in the forgoing paragraph of this application, I verify this application
