Petition under Section 205 of Criminal Procedure Code 1973

 

 

 

 

 

District : South 24 Parganas.

                                                          Complaint Case no. 2670 of 2010.

Sri Amiya Mondal. ________Accused.

 

Petition under Section 205 of Criminal Procedure Code’ 1973.

 

The humble petition of the above named accused person, most respectfully;

 

Sheweth as under :

 

1.           That the accused petitioner is a peace loving and law abiding  Senior Citizen, residing permanently at premises being no. 3 / A, Michael Madhusudan Dutta Road, Budge Budge, Kolkata – 700 137, District – South 24 Parganas, which is well within the jurisdiction of this Learned Court.

 

2.           That the accused person is an old aged person suffering from different old aged ailment and not able to move much from his house, and for this reason alone, the accused person seek to get dispense with his personal attendance in the above referred case matter before this Learned Court.

 

3.           That the accused petitioner suffering a lot in traveling to reach the Learned Court, as such the residence of the accused petitioner is situated at the distance of 60 K.M. from the location of the Learned Court, as such the traveling of the accused petitioner consist auto, train, and bus to reach the Learned Court and also engaged with ample time also, and whereas the accused person’s old aged body do not permit for such long traveling and for this reasons also the accused person seeks to get dispense with personal attendance in the above referred case matter before the Learned Court.

 

4.           That the accused petitioner state and submits that the above referred case matter is a summary nature case matter and the accused petitioner should get relief in terms of the provisions of Section 205 of Cr.P.C. 1973, in the interest of administration of justice.

 

5.           That the accused petitioner state and submits that the accused petitioner will not challenge his identity at the time of trial and or evidence of the above referred case matter before the Learned Court.

 

6.           That the accused petitioner state and submits that the accused petitioner should allow to represent through his Learned Advocate Sri Ashok Kumar Singh, in the above referred case matter, before the Learned Court.

 

 

7.           That the accused petitioner undertake to appear all and or on every occasions, as and when directed by the Learned Court in the above referred case matter.

 

8.           That the balance of convenience and inconvenience are in favour of the accused person and the Complainant will not be prejudice in any manner, whatsoever.

 

9.           That this application is made bonafide in the interest of administration of justice.

 

It is therefore prayed that your Honour would be graciously pleased to allow this application under Section 205 of the Criminal Procedure Code’ 1973, and to dispense with the personal attendance of the accused person in the above referred case matter and to allow the Learned Advocate Sri Ashok Kumar Singh, to represent the accused person in his absence in the above referred case matter before the Learned Court, and to pass such other necessary order or orders as your Honour may deem, fit, and proper for the end of justice.

 

And for this act of kindness, the Petitioner, as in duty bound shall ever pray.
