SUIT FOR RESTITUTION OF CONJUGAL RIGHTS UNDER SECTION 9 OF THE HINDU MARRIAGE ACT, 1955.

 

The petitioner states as follows:-

 

1. That the petitioner and the respondent are both Hindus suijuris and citizens of India.

 

2. That the petitioner then a bachelor and the respondent then a spinster at the time of marriage and to married each other, which was solemnized on 19.11.2013 at 1/7, Adyanath Saha Road, Lake Town, P.S. Patipukur, P.O..…………, Kolkata-700048, District South 24pgs(s). according to Hindu rites and customs in presences of the guardians, relatives and wishers of both the parties.

3. That on the following day i.e. 20.11.2013 the petitioner brought his newly wedded bride i.e. the respondent at his house i.e. A10/12/3, Satyen Park, P.S. Haridevpur, P.O. Joka, Kolkata-700104, District South 24pgs(s).                                                                    

 

 

4. That on the next day i.e. 20.11.2013 the religious aspect of “Bhoubhat ceremony” was performed at the house of the petitioner. Many invitees and guests were attended the ceremony in the evening. The petitioner and the respondent lived together as husband and wife since then.

 

5. That from the very beginning of their marriage the respondent/wife was found very much reluctant to participate in daily household chores and after used to refuse to assist the mother of the petitioner/husband in any way in any of the household work with the result that the old mother-in-law of the respondent/wife had to work hard from down to midnight, such attitude and also her refusal to work shocked the petitioner/husband very much mentally. However, the petitioner/husband used to request the respondent/wife became furious and did never hesitate to abuse her in-law and husband too in objectionable language.    

 

7. That on  03.09.2015  the respondent without reasonable excuse and with a view to break the marital tie left her matrimonial home without taking any permission either from the petitioner/husband or any of his family members and after that the petitioner requested several times to the respondent/wife to return her matrimonial home but the respondent primarily refused to return at her matrimonial home even the petitioner on 04.09.2015  went to the house of his wife at 1/7, Adyanath Saha Road,  Lake Town, P.S. Patipukur, P.O..…………, Kolkata-700048, District South 24pgs(s).  to return back the respondent at his house but the respondent firmly refused to return at her matrimonial home and willfully avoid to staying with your Petitioner/husband for performance of their marital life.

 

8. That the petitioner/husband submits that none of the cruel acts and conducts of the  respondent/wife as specifically stated herein before has been condoned.

 

9. That the instant petition is not filed in the collusion with the respondent/wife.

10. That the cause of action arose on 03.09.2015 when the respondent left her matrimonial home and started to reside at her father’s house at 1/7, Adyanath Saha Road,  Lake Town, P.S. Patipukur, P.O..…………, Kolkata-700048, District South 24pgs(s). within your Honor’s Court Jurisdiction of Alipore.

 

11. That this application is made bona fide and for ends of justices.

 

12. That there has not been any unnecessary or improper delay in filing this petition.

 

13. There is no legal ground why relief should not be granted.

 

14. There has not been previous proceeding with regard to the marriage by or on behalf of party.

                                                                           would graciously  be  pleased  to  pass  an

                                                                         order and decree as follows:-    

                                                                   (a).   For a decree for restitution of conjugal  

                                                                            rights against the respondent.

                                                                   (b).   any other  relief or relief  your Honour
