Power of Governmentto withdraw exemption for concession granted in respect oftaxes.- The State Government may at any time by order inwriting withdraw any exemption from, or concession in respectof, any tax granted to any person by the Government of theformer Baroda State by an order issued under the `A' ClassMunicipalities Act (Baroda Act No. XII of 1949)."[(2)] In Section 91-A-(i) after sub-section (2), the followingshall be inserted, namely:-"(2A) It shall be the dutyof every Municipality to maintain every regular line of thepublic street prescribed or sanctioned by the Government of theformer Baroda State at any time prior to the 301h day of July,1949:Provided that the Municipality may alter or cancel anysuch regular line if having regard to the needs of traffic-(a)it was before the aforesaid date classified by the Municipality,with the sanction of the Government of the former Baroda State,as unimportant, or(b) it is so classified by theMunicipality with the sanction of the State Government withintwo years from the commencement of the Bombay Merged States(Laws) (Second Amendment) Act, 1951 (Bombay XXXII of1951)."(ii) in sub-section (3), the following shall beadded at the end, namely:-"Explanation.-For thepurposes of this section, the regular line of the public street'shall include a regular line of public street prescribed orsanctioned by the Government of the former Baroda State at anytime prior to the 30th July, 1949."][(3)] AfterSection 180 of the Bombay District Municipal Act, 1901 (BombayIll of 1901), the following section shall be inserted, namely:-"180-A.(1) Notwithstanding anything containedin the foregoing provisions of this Act, such rules, by-laws,orders made, issued or sanctioned by or in respect of any of theMunicipalities whether constituted under the A ClassMunicipalities Act (Baroda No, XII of 1949) or the B ClassMunicipalities Act (Baroda No. XIV of 1949) of the former BarodaState (hereinafter called "the said Municipalities"and "the said Baroda Municipalities Acts"respectively) as were in force immediately before the 30lh dayof July, 1949 under the said Baroda Municipalities Acts, shallin so far as they are consistent with the provisions of theBombay District Municipal Act, 1901 (Bombay Ill of 1901), shallbe deemed to have been made, issued or sanctioned by or inrespect of the said Municipalities under the appropriateprovisions of the said Act on the said date and continue inforce until altered, repealed or amended by a competentauthority.(2) All references to the Baroda Government or toany officer of the Baroda Government in any such rules, by-lawsor orders shall be construed as references to the Government ofBombay or the corresponding officer of the Government of Bombay,as the case may be; and all licenses, permits or permissionissued or given under any such rules, bylaws or orders shallalso continue in force until superseded or modified by acompetent authority." |

done or purported to have been done in respect of anysuch appointment, notification, notice, order, scheme, licence,permission, rule, by-law, form or tax, under the DistrictMunicipal Act or this act, in respect of the said areas, in sofar as such appointment, notification, notice, order, scheme,licence, permission, rule, by-law, form, tax or thing is notinconsistent with the provisions of the District Municipal Actor this Act, as the case may be, shall be legal and valid andshall be deemed to have been legal and valid in respect of thesaid areas from the dates on which it was made, issued, imposedor done, as the case may be and shall continue in force unlessand until it is superseded by any other appointment,notification, notice, order, scheme, licence, permission, rule,by-law, form or tax made, issued or imposed or anything doneunder this Act."[(A-2) After Schedule I, the followingSchedule shall be inserted, namely:-"ScheduleI-A.Beginning from the East-South corner of Survey No. turning South and going along the eastern boundaryof Survey Nos. 753, 752, 751, 1014/1, 1013, 1011/1, 1010/1,1009, 1007/1-2, 1006, 1005/1-2, 1004, 1003/1, 1001, 1000 and 999and then walking along the Railway siding of the AlembicChemical Works upto its junction with the main lines, thenturning to the West and reaching the southern boundary of SurveyNo. 984 of Gorwa village and walking along the eastern boundaryof Survey Nos. 627, 626, 625 and 624 up to its South-East cornerand then turning West and walking along its southern boundaryand reaching South-West corner of Survey No. 623 and thenturning towards North along the boundaries of Survey Nos. 623and 622 and then crossing the road and reaching the South-Eastcorner of Survey No. 1084 of Gorwa village and turning to theWest along the southern boundaries of Survey Nos. 1084, 1085,1088, 1091 and 1092 reaching to the main road of the Industrialzone."] [(1) After Section 103, the following sectionshall be inserted, namely:-"(103A) Power ofGovernment to withdraw exemption or concession granted inrespect of taxes.- The State Government may at any time byorder in writing withdraw any exemption from, or any concessionin respect of, any tax granted to any person by the Governmentof the former Baroda State by an order issued under the `A'Class Municipalities Act (Baroda Act No. XII of 1949)."] [(2)] In Section 118,- (i) after sub-section (2) the following shallbe inserted, namely:-"(2A) It shall be the duty ofevery municipality to maintain every regular line of the publicstreet prescribed or sanctioned by the Government of
