Legal Notice for Consumer Case

My Client : M/s. Triparna Traders, a Sole Proprietorship firm having it’s address at premises being no. 444, M.G.Road, Kolkata – 700 137, at Charial Bazar, Police Station Budge Budge, District – South 24 Parganas, represented by it’s Sole Proprietor Shri Malay Bhattacherjee, Son of Late Nani Gopal Bhattacharjee. 

 

Dear Sir/s,

 

 

          Under instructions of my client M/s. Triparna Traders, a Sole Proprietorship firm having it’s address at premises being no. 444, M.G.Road, Kolkata – 700 137, at Charial Bazar, Police Station Budge Budge, District – South 24 Parganas, represented by it’s Sole Proprietor Shri Malay Bhattacherjee, Son of Late Nani Gopal Bhattacharjee, I hereby states as follows :

 

 

 

1)   That your employee Sri Subhasish Manna, visited the Shop of my client at Budge Budge and convinced about the products and services of yours to my client and obtained thereby an order for your products vide Order no. 1453, dated 06-08-2014, taken by your Employee Sri subhasis Manna having Employee Code A70088, and thereafter for such order your said employee taken out the payments of Rs. 20,000/- as on 28-07-2014, vide Voucher no. ADV – 000022, and thereafter on 11-08-2014, Rs. 5,000/- only by being Voucher no. ADV – 000037, and thus totaling of Rs. 25,000/- ( Rupees Twenty Five Thousand ) only taken by you against such order placed by my client, it is pertinent to state that the order was for value of Rs. 24,154.75 only.

 

2)   That in spite of having total payments in advance against the order of the goods / products of your company, you did not deliver and or give the goods / products to my client till date. My client off and on meeting with your employee Sri Subhasis Manna as well as visiting your offices in the district of Purba Medinipur, but still your concern did not deliver and or give the goods / products to my client as per the order placed by him to you.

 

3)   That on 9th day of July’2015, your said Employee Shri Subhasish Manna visited the Shop of my Client at Budge Budge and said that you will not deliver the goods as ordered by my client and finally refused and neglect to deliver the goods as ordered by my client, even after having full and total payments thereof.

 

4)   That you have taken the full payments against the order placed by my client but you did not deliver and or supply the goods to my client, is established acts and deeds of deficiency in services and unfair trade practices, as meant in the provisions of the Consumer Protection Act’ 1986.

 

 

 

5)   That however my client is in believed that good sense will prevail on you, seeks to get his goods and products as ordered by him at an early date preferably within a period of fortnight from the date of receipt of this notice.

 

 

I for and on behalf of my client requesting you to deliver the goods and or products as per order being no. 1453, dated 06-08-2014, at an early date preferably within a period of fortnight from the date of receipt of this Legal Notice with you, failing which, and or otherwise my client shall institute appropriate legal proceeding before the competent court of law, against you, at your cost and perils, which please note, copy kept.
