Complaint case of Shri Jyoti Prokash Chakraborty, Son of Late Chandi Charan
Chakraborty, residing at Village – Sahebpara, P.O. & P.S. Sonarpur,
District South 24 Parganas, against two hospitals and ten doctors for their
medical negligence and deficiency in services on the death of his minor child namely
Master jyodipto Chakraborty of 6 years old, who died on 04-05-2009, vide
CC/195/2013, before the Hon’ble State Consumer Disputes Redressal Commission,
West Bengal, claiming the amount of expenses already incurred as of Rs.
2,95,912.95 and compensation as of Rs. 97,00,000/-only.

Please note that the above referred Consumer complaint case
being CC/195 / 2013 { Shri Jyoti Prokash Chakraborty – Versus – The Institute
of Child Health Trust and Others } before the Hon’ble State Consumer Disputes
Redressal Commission, West Bengal, at premises being no. 11A, Mirza Ghalib
Street, Kolkata – 700 087, has been filed by my client Shri Jyoti Prokash
Chakraborty, Son of Late Chandi Charan Chakraborty, residing at Village –
Sahebpara, P.O. & P.S. Sonarpur, District – South 24 Parganas, Kolkata –
700 150, against the Institute of Child Health Trust, Dr. Joydeep Roy, Dr. (
Miss ) Manjuri Mitra, Dr. P.G.Khandelwal, Dr. Ashok Kumar Basu, Dr. Saran
Pradeep, Dr. Birendra Rai, Dr. ( Mrs. ) Purnima Basu, The Calcutta Medical
Research Institute, Dr. Saugata Acharya, Dr. Abhijit Chattopadhyay, and Dr. Uma
Prasana Ghosal, for their medical negligence and deficiency in services on the
death of his minor child namely Master jyodipto Chakraborty of 6 years old, who
died on 04-05-2009, at CMRI, Kolkata, under the jurisdiction of the Alipore Police
Station.
The above referred complaint
case is still pending for adjudication before the Hon’ble State Consumer
Disputes Redressal Commission, West Bengal.
All the doctors and hospitals
made there appearance in the said consumer complaint case of my client before
the Hon’ble State Consumer Disputes Redressal Commission, west Bengal.
The next date in the above
referred case matter is on 15th day of July’ 2015, for submission of
the WRITTEN VERSION by the respondents Doctors and Hospitals and hearing of one
Misc. Application being no. MA / 245 / 2015 { Dr. Ashok Kumar Basu, The
Institute of Child Health Trust – Versus – Shri Jyoti Prokash Chakraborty }.
The said Misc. application was
filed only by Dr. Ashok Kumar Basu, though no copy of his such petition has
ever been served by his Learned Advocate, and therefore the Hon’ble Commission
on earlier occasion directed for service of copy of such application to the
complainant and to the rest of the respondents, prior to the date of hearing as
fixed as on 15th day of July’ 2015.
Medical negligence was caused
due to following acts and deeds :
a) Operation of Master Jyodipto
Chakraborty, at the Institute of Child Heath Trust, on 22-04-2009, by Dr. Ashok
Kumar Basu and his team of Doctors, done without the consent of the parents of
the child.
b) Drug abused as prescribed
without medical norms to the child.
c) Operation was wrongly conducted
at right side, insist of left side operation.
d) Shifted and admitted Master
Jyodipto Chakraborty, to the CMRI, without consent of the parents of the child,
by Dr. Ashok Kumar Basu, and his team of Doctors at the Institute of Child
Health Trust.
e) No proper treatment has ever
been carried out at the Institute of Child Health Trust and or at CMRI,
Kolkata.
f) No proper communication has
ever been made by the Doctors at the said Two Hospitals to the parents of the
Child.
g) Declared mysterious death of
the child at CMRI, Kolkata on 04-05-2009.

in the state of West Bengal, for the purpose of awareness to raise voices
against the medical negligence and deficiency in services of Doctors and
Hospitals.
