The Law Degree is only Beginning

The Importance of Learning Under Senior Advocates: The Foundation of a Successful Legal Career

The Importance of Learning Under Senior Advocates: The Foundation of a Successful Legal Career

An Elaborate Reflection on the Observations of Justice B. V. Nagarathna

The legal profession is not merely a means of earning a livelihood. It is a noble calling, a profound responsibility, and an institution upon which the administration of justice substantially depends. To become a successful advocate, the possession of a law degree is only the beginning. The real journey commences when a young lawyer enters the courtroom, observes experienced practitioners, studies the art of advocacy, and gradually learns the traditions, discipline, ethics, and professional etiquette of the Bar.

The recent observations attributed to Hon’ble Justice B. V. Nagarathna of the Supreme Court of India, concerning young lawyers who establish independent offices without adequate training under senior advocates, raise an important question about the future of the legal profession.

According to the report published by LiveLaw on 18 September 2026, Justice Nagarathna emphasised that young advocates who immediately commence independent practice may miss the opportunity to acquire the real skills of advocacy, professional niceties, and essential interpersonal abilities that are developed through experience and guidance. She also stressed the importance of sitting in court and learning from seniors.

Obtaining an LL.B. degree provides a lawyer with the academic foundation of legal knowledge. It introduces the student to statutes, legal principles, constitutional provisions, judicial precedents, and the theoretical framework of justice.

However, the courtroom presents challenges that cannot always be mastered through textbooks or examinations.

A young advocate must learn:

  • How to read and understand a case file comprehensively.

  • How to identify the real legal issues in a dispute.

  • How to draft pleadings, petitions, applications, and written submissions.

  • How to conduct effective examination-in-chief and cross-examination.

  • How to address the Court with clarity, precision, and dignity.

  • How to distinguish between a legally relevant argument and an unnecessary submission.

  • How to manage clients, deadlines, professional relationships, and courtroom responsibilities.

These abilities develop through a combination of education, observation, practice, discipline, and experience.

The law college teaches the language of law; the courtroom teaches the practical application of that language.

2. The Value of Training Under Senior Advocates

Training under an experienced advocate is an important part of professional development. A senior may provide insights that are difficult to acquire independently, including the practical application of legal strategy, courtroom discipline, drafting techniques, and professional conduct.

A young lawyer who carefully observes a senior advocate can learn not only what to argue, but also when to argue, how to argue, and when not to argue.

The wisdom of the legal profession is transmitted through generations. Every experienced lawyer was once a beginner, and every new generation has the opportunity to preserve valuable traditions while improving the profession.

Nevertheless, mentorship should be understood as a process of learning and professional development—not as the surrender of independent thought. A young advocate must develop the confidence to think independently while respecting the experience of those who have travelled the path before.

3. The Importance of Professional Etiquette

The word “niceties” in the context of the legal profession carries considerable significance.

Professional etiquette includes the manner in which an advocate addresses the Court, interacts with colleagues, communicates with clients, and conducts himself or herself in the administration of justice.

A good advocate must understand that:

Courtesy is not a sign of weakness; it is a reflection of professional strength and self-discipline.

Disagreement between advocates is a natural feature of litigation. However, disagreement must never become personal hostility. An advocate may firmly challenge an argument, dispute a submission, or defend a client’s interests without compromising dignity and civility.

The legal profession is a community in which advocates who oppose one another in one case may stand together in another. Mutual respect is therefore not merely a matter of tradition; it is an essential element of a healthy and functioning Bar.

4. The Difference Between Independence and Premature Independence

Every young lawyer dreams of establishing an independent practice. Such ambition is natural and deserves encouragement.

However, independence must be supported by preparation, competence, and responsibility.

Opening an office, purchasing a nameplate, printing visiting cards, or obtaining a professional identity does not, by itself, establish a successful legal practice.

A lawyer must also possess the ability to:

  • Protect the interests of clients through competent legal assistance.

  • Understand procedural requirements.

  • Prepare cases meticulously.

  • Conduct effective legal research.

  • Maintain professional confidentiality.

  • Recognise personal limitations and seek assistance when necessary.

  • Continue learning throughout a professional career.

At the same time, not every young advocate has the opportunity to work under a senior. Financial circumstances, family responsibilities, geographical limitations, and the availability of suitable mentors may influence a lawyer’s career path.

Therefore, the broader lesson is not that every lawyer must follow one identical route, but that every aspiring advocate should seek meaningful practical training, wherever reasonably possible.

5. Courtroom Observation: An Unmatched School of Advocacy

The courtroom is a living institution of legal education.

By observing experienced advocates, young lawyers can understand how legal principles are translated into persuasive submissions, how judges engage with difficult questions, and how the presentation of a case can influence the clarity of judicial decision-making.

The young advocate should observe:

  • How a senior organises a case before entering the courtroom.

  • How questions from the Bench are answered.

  • How difficult facts are addressed honestly and strategically.

  • How precedents are distinguished or relied upon.

  • How submissions are kept focused on the issues that matter.

  • How professional composure is maintained under pressure.

A lawyer who learns to listen attentively often develops the ability to argue more effectively.

In litigation, the power of advocacy lies not merely in speaking, but in knowing what deserves to be said.

6. Ethics Must Remain the Foundation of Legal Practice

No amount of professional success can compensate for the abandonment of legal ethics.

An advocate’s first responsibility is to uphold the law, protect the legitimate interests of the client, and assist the Court in the administration of justice.

Young lawyers must understand that professional success cannot be measured exclusively by the number of cases handled, the fees earned, or the size of an office.

True professional achievement is reflected in:

  • Integrity in dealing with clients and colleagues.

  • Honesty in presenting facts and law.

  • Respect for the judicial institution.

  • Commitment to preparation.

  • Accountability for professional conduct.

  • Dedication to the cause of justice.

The legal profession demands both intellectual ability and moral responsibility.

7. Mentorship Must Evolve With the Changing Times

While traditional apprenticeship under senior advocates remains valuable, the legal profession is evolving rapidly.

Modern legal education must also embrace:

  • Digital legal research and technological tools.

  • Contemporary methods of case management.

  • Professional communication skills.

  • Alternative dispute resolution.

  • Legal writing and analytical reasoning.

  • Awareness of new legislation and procedural developments.

Senior advocates have an important role in guiding young professionals through these changes, while young lawyers bring new perspectives, technological awareness, and fresh intellectual energy to the profession.

Experience and innovation should complement each other, not compete with each other.

8. A Message to Young Advocates

To every young lawyer beginning a professional journey, the message is simple:

Do not mistake a professional identity for professional competence.

Do not allow ambition to replace preparation.

Do not consider the process of learning from seniors a sign of inferiority.

Every file you study, every hearing you observe, every draft you prepare, and every mistake you correct contributes to your growth as an advocate.

Be patient, but remain ambitious. Be confident, but remain humble. Be independent in thought, but receptive to sound guidance.

The finest advocates are not necessarily those who speak the most. They are those who understand the law deeply, prepare their cases thoroughly, conduct themselves with dignity, and remain committed to justice.

Conclusion: Building the Future of the Legal Profession

The observations of Justice B. V. Nagarathna offer an opportunity for meaningful reflection on the importance of professional training, mentorship, and ethical development within the legal fraternity.

The future of the Bar depends not only on the number of lawyers entering the profession, but also on the quality of their preparation, their commitment to learning, and their respect for the institutions of justice.

Let every young advocate remember: A successful legal career is not built in a day. It is built through years of learning, discipline, experience, integrity, and unwavering dedication to the rule of law.

May the younger generation of advocates rise with knowledge, practise with honesty, argue with dignity, and serve the cause of justice with distinction.

Reflections on Legal Education, Professional Ethics and the Future of Advocacy

VAKALAT — The Dignity, Responsibility and Constitutional Significance of the Legal Profession

Advocacy Is Not Merely a Profession; It Is a Commitment to Justice.

By Ashok Kumar Singh, Advocate, High Court, Calcutta

The Meaning and Essence of Vakalat

The word “Vakalat” carries a profound meaning within the Indian legal system. It is not merely a means of earning a livelihood, nor is it simply the act of appearing before a court of law. Vakalat represents the solemn responsibility of standing beside a person when that person seeks justice, protection of rights, or an opportunity to be heard under the law.

An advocate is entrusted with the confidence of clients, the responsibility of presenting facts fairly, and the duty to assist the court in the proper administration of justice. Behind every brief lies a human story. Behind every legal dispute lies a question of rights, responsibility, dignity, or accountability.

The black coat of an advocate is therefore not merely an item of professional attire. It symbolises discipline, commitment, professional identity, and the obligation to uphold the principles of justice.

1. Vakalat Is a Responsibility, Not a Licence for Arrogance

The legal profession provides advocates with an important role in the administration of justice. However, the privilege of appearing before a court must never be mistaken for personal superiority.

An advocate may possess extensive legal knowledge, years of experience, and professional recognition, but true excellence in advocacy is reflected in the manner in which that knowledge is used.

A responsible advocate:

  • Respects the court, fellow advocates, litigants, and witnesses.

  • Protects the legitimate interests of clients through lawful means.

  • Avoids misleading the court or misrepresenting material facts.

  • Maintains confidentiality and professional integrity.

  • Recognises that every litigant deserves a fair opportunity to be heard.

  • Understands the difference between forceful advocacy and personal hostility.

The strength of an advocate is not measured by the volume of their voice, but by the force of their reasoning, the accuracy of their submissions, and the integrity of their conduct.

2. The Advocate as an Officer of the Court

An advocate occupies a distinctive position in the justice-delivery system. While representing the interests of a client, an advocate also has professional obligations towards the court.

The court relies upon advocates for accurate legal submissions, proper assistance in the presentation of cases, and responsible engagement with the judicial process.

Advocacy is not a contest in which every method is justified by the desire to win. It is a disciplined process through which competing claims are examined according to law and evidence.

An advocate must therefore have the courage to advance a client's legitimate case with determination while retaining the honesty to acknowledge an unfavourable legal position when professional duty requires it.

A lawyer's first duty is to the administration of justice; the client's cause must be pursued within the boundaries of law and professional ethics.

3. Vakalat and the Rule of Law

The rule of law is one of the foundational principles of a constitutional democracy. It signifies that individuals, institutions, and public authorities are subject to law.

The legal profession plays a vital role in ensuring that this principle is not reduced to a mere constitutional expression.

When an advocate challenges unlawful detention, contests an arbitrary administrative decision, defends an accused person, protects property rights, or seeks relief against an unlawful action, the advocate contributes to the practical enforcement of legal rights.

The advocate's responsibility is not to determine who deserves justice based on personal preference. It is to ensure that the applicable law is properly placed before the competent forum and that legal rights are protected through due process.

Where the rule of law is respected, justice does not depend upon wealth, influence, social standing, or personal connections.

4. The Dignity of the Legal Profession

The dignity of the legal profession is built through conduct rather than declarations.

A profession becomes respected when its members demonstrate intellectual honesty, professional discipline, mutual courtesy, and independence of thought.

Differences of opinion among advocates are natural. Disagreements regarding legal strategy, interpretation of statutes, or professional matters are inevitable. Nevertheless, such disagreements should be addressed through reasoned discussion and appropriate institutional mechanisms.

Personal attacks, unnecessary humiliation, deliberate misinformation, and disregard for professional etiquette can undermine the confidence that the public places in the legal system.

The dignity of the Bar is a collective responsibility. Every advocate contributes to the reputation of the profession through everyday conduct—inside the courtroom, in professional associations, and in public life.

5. Vakalat Requires Courage and Independence

An advocate must possess the courage to raise legitimate legal questions, challenge unlawful actions, and defend the rights of individuals even when doing so is difficult.

Independence of the Bar is essential to the proper functioning of the justice system. An advocate should be able to represent a client fearlessly, subject to the law and professional obligations, without being improperly influenced by external pressure.

However, professional independence does not mean freedom from accountability. Every exercise of professional authority must remain consistent with statutory provisions, judicial discipline, ethical obligations, and the dignity of the institution.

Fearlessness in advocacy must be accompanied by responsibility, and independence must be guided by integrity.

6. The Relationship Between Senior and Junior Advocates

The legal profession is strengthened when experience is shared and professional knowledge is passed from one generation to another.

Senior advocates and experienced members of the Bar have an important role in mentoring younger practitioners. Junior advocates, in turn, should cultivate discipline, preparation, humility, and a willingness to learn.

A healthy professional environment encourages:

  • Respectful guidance and mentorship.

  • Fair opportunities to develop legal skills.

  • Recognition of merit and hard work.

  • Constructive criticism rather than personal humiliation.

  • Cooperation in matters concerning the functioning of the Bar.

  • Commitment to the improvement of professional standards.

The growth of one advocate need not diminish the contribution of another. A strong Bar is one in which knowledge, experience, and opportunities are shared responsibly.

7. Vakalat and the Duty Towards Society

The role of an advocate extends beyond the courtroom.

Lawyers can contribute to society through legal-awareness programmes, pro bono assistance, public education, support for vulnerable persons, and responsible participation in discussions concerning legal rights and civic duties.

An advocate's knowledge of law creates an opportunity to help people understand their rights and obligations.

At the same time, legal awareness must be based on accurate information. Public commentary on legal issues should distinguish between established law, allegations, personal opinions, and matters that remain pending before a court.

The true social value of Vakalat lies in making the law more accessible, understandable, and meaningful to ordinary people.

8. Vakalat in the Age of Social Media

In the modern era, advocates increasingly use social media to communicate legal information, discuss professional issues, and express views on matters of public interest.

This creates both opportunities and responsibilities.

An advocate should exercise care while sharing legal commentary, photographs, opinions, or information concerning pending proceedings. Professional conduct must not be compromised by the desire for publicity or online recognition.

A legal professional should remember that public communication can influence how people perceive the justice system. Accuracy, restraint, privacy, and professional courtesy are therefore essential.

The right to express an opinion must coexist with the responsibility to avoid misleading statements and conduct inconsistent with applicable professional standards.

9. The Real Measure of an Advocate

The success of an advocate cannot be measured solely by the number of cases won, the volume of briefs handled, or the degree of public recognition achieved.

A meaningful professional legacy may be reflected in:

  • The trust earned from clients.

  • The quality of assistance provided to the court.

  • The rights protected through lawful advocacy.

  • The respect shown to colleagues and opponents.

  • The professional knowledge shared with younger lawyers.

  • The contribution made to the legal community and society.

An advocate's name may appear on countless pleadings, but the lasting value of their work lies in the fairness, diligence, and integrity with which those pleadings were prepared and presented.

A Message to the Legal Fraternity

Let us preserve the dignity of Vakalat by placing law above personal ego, justice above prejudice, professional ethics above convenience, and constitutional values above arbitrary power.

Let us disagree with arguments, not with personal hostility.

Let us defend our clients with courage, but never forget our obligations to the court.

Let us respect the institution of the Bar and work towards creating a professional environment where every advocate—irrespective of seniority, background, or financial circumstances—can pursue the legal profession with dignity.

Let us remember that the black coat carries a responsibility greater than individual ambition. It represents a profession that exists to assist in the administration of justice and to uphold the values of the legal system.

Vakalat is a commitment to law. Vakalat is a responsibility towards justice. Vakalat is a lifelong journey of learning, discipline, courage, and integrity.

Be Proud of Yourself

Be Proud of Yourself — Your Silent Battles Have Made You Stronger

Be Proud of Yourself — Your Silent Battles Have Made You Stronger

No one knows the battles you face in silence. No one has witnessed every tear you have held back, every disappointment you have endured, every fear you have conquered, or every difficult moment through which you have continued to move forward. Yet, here you are—still standing, still trying, and still hoping.

Life is not always about grand achievements, public recognition, or the applause of others. Sometimes, the greatest victories are the ones that remain invisible to the world. Waking up with a heavy heart and choosing to face another day, remaining patient when circumstances test your limits, maintaining your dignity when others misunderstand you, and continuing your journey despite repeated setbacks—these are achievements that deserve acknowledgment.

Be proud of yourself, not because your life is perfect, but because you have refused to surrender to every difficulty that has come your way.

There may have been moments when you felt alone, when your efforts went unnoticed, when your sincerity was questioned, or when the people you trusted failed to understand your struggles. There may have been nights when you silently searched for answers and mornings when you had to gather the courage to begin again.

Remember, however, that your worth is not determined by the opinions of others. Your value does not diminish because someone fails to recognize your efforts. You do not need constant approval to validate your existence, your dreams, or your journey.

Your life is your own story. Only you truly know the distance you have travelled, the obstacles you have overcome, and the strength it has taken to become the person you are today.

Do not compare your journey with someone else's. Every individual has a different struggle, a different timeline, and a different destination. What may appear to be a small step to the world could be a remarkable achievement in your personal journey.

Take pride in your honesty. Take pride in your patience. Take pride in your courage to begin again. Take pride in the lessons you have learned from failure. Take pride in the kindness you have preserved despite being hurt.

And remember, asking for help is not weakness, expressing your emotions is not defeat, and taking a moment to rest is not surrender. True strength also lies in knowing when to pause, reflect, heal, and seek support.

Let your progress speak for itself. Let your character define you. Let your actions reflect your values. You do not have to explain every struggle or prove your worth to everyone.

One day, you may look back and realize that the difficulties you once thought would break you helped you discover your inner strength, deepen your wisdom, and understand the true meaning of self-respect.

Until that day, keep moving forward with faith, courage, humility, and determination.

Be proud of yourself. Your silent battles matter. Your unseen efforts matter. Your journey matters. And even when nobody applauds, your perseverance is still worthy of respect.

🌟 Believe in yourself. Respect your journey. Honour your struggles. Never lose hope.

With faith in humanity and respect for every individual's silent journey.
