AFFIDAVIT OF SERVICE

On behalf of Defendants

 

I, Smt. Hasna Bewa, W/o Late Janaruddin Sekh, aged about ____years, by faith Muslim, by Occupation Business, residing at Village – Ustia, Post Office Muktinagar, Police Station – Berhampore, District – Murshidabad, Pin - 742102, being the Defendant No. 2 in the aforesaid proceeding, do hereby solemnly affirm and state as follows:

 

1. That I am the Defendant No. 2 in the aforesaid O.A. and am well acquainted with the facts and circumstances of the case and, as such, I am competent and authorised to swear this Affidavit of Service.

 

2. That the Learned Advocate appearing on my behalf has prepared the Written Notes of Arguments on behalf of the Defendants in connection with the hearing and final adjudication of the aforesaid O.A. No. 15 of 2024, dealing with the pleadings, documents and materials on record, including the Original Application filed by the Applicant Bank, the Written Statements filed on behalf of the Defendants and the Rejoinder filed by the Applicant Bank.

 

3. That in compliance with the requirement of service and in order to furnish a copy of the Written Notes of Arguments to the Applicant Bank and its Learned Advocate, a copy of the said Written Notes of Arguments was duly served upon the Applicant Bank/its Authorised Officer and upon the Learned Advocate representing the Applicant Bank in the aforesaid O.A.

 

4. That the said Written Notes of Arguments were forwarded/served along with a covering communication dated 12^th day of August’ 2026, addressed to the Authorised Officer/Authorised Representative of Punjab National Bank, ARMB, Murshidabad, at its address being Circle Office Murshidabad, 3^rd Floor, BSNL Telephone Exchange Building, Cantonment Road, P.O. & P.S. Berhampore, District Murshidabad, West Bengal, Pin - 742101, and a copy thereof was also served upon the Learned Advocate appearing on behalf of the Applicant Bank in O.A. No. 15 of 2024, for their information, record and necessary action.

 

5. That the aforesaid service was effected on ____________ by ____________ mode, namely, by Speed Post/Courier/Email/hand delivery, as the case may be. The relevant postal receipt/tracking report/email delivery report/acknowledgment evidencing such service is annexed hereto and marked as “Annexure–A”.

 

6. That the copy of the Written Notes of Arguments so served upon the Applicant Bank and its Learned Advocate was a true and correct copy of the Written Notes of Arguments intended to be relied upon and submitted on behalf of the Defendants before the Learned Tribunal.

 

7. That the service was made without prejudice to the rights and contentions of the Defendants and without admitting any of the allegations, claims, outstanding amounts or submissions made by the Applicant Bank in the aforesaid O.A.

 

8. That the Applicant Bank and its Learned Advocate have accordingly been duly furnished with a copy of the Written Notes of Arguments, and sufficient opportunity has thereby been afforded to them to take note of the submissions made on behalf of the Defendants and to respond thereto, if so advised.

 

9. That this Affidavit is being filed before this Learned Tribunal for the purpose of placing on record the factum of due service of the Written Notes of Arguments upon the Applicant Bank and its Learned Advocate.

 

10. That the statements made hereinabove are true and correct to my knowledge and belief, and the documents annexed hereto are true copies of their respective originals.

 

 

 

 

 

 

 

 

VERIFICATION

 

I, Smt. Hasna Bewa, the above-named deponent, do hereby verify that the statements contained in paragraphs 1 to 10 hereinabove are true and correct to my knowledge and belief, based on the records of the case and information received from my Learned Advocate, which I believe to be true.

 

I further state that nothing material has been concealed therefrom.
