The Decree Holder filed Consumer Complaint No. SC/19/CC/263/2020 before the Hon’ble State Consumer Disputes Redressal Commission, West Bengal, alleging deficiency in service and unfair trade practice on the part of the Opposite Parties.

During 2020–2024

Notices were duly served upon the Opposite Parties. They entered appearance and filed their Written Versions but deliberately abstained from participating in the trial proceedings.

11.06.2025

This Hon’ble Commission was pleased to finally allow the Consumer Complaint ex parte on merits and passed a reasoned Order & Judgment directing the Opposite Parties jointly and severally to refund Rs. 24,22,603/-, pay compensation of Rs. 50,000/- and litigation cost of Rs. 30,000/- within one month, failing which interest @ 7% per annum was payable till realisation.

July 2025

The statutory period for compliance with the Order & Judgment dated 11.06.2025 expired. The Opposite Parties failed to comply with the directions of this Hon’ble Commission.

2025

The Decree Holder detected certain clerical and typographical errors in the refundable amount mentioned in the judgment and accordingly filed a limited Review Application being SC/19/RA/20/2025 seeking clerical correction only.

09.10.2025

This Hon’ble Commission was pleased to allow the Review Application by Order No. 17 dated 09.10.2025, correcting and clarifying the payable amounts without altering the substantive liability of the Opposite Parties.

November 2025

Even after the correction order, the Opposite Parties failed and neglected to comply with the decree. No appeal or stay was preferred or obtained.

26.12.2025

The Decree Holder issued a legal notice to the Opposite Parties calling upon them to comply with the decree within fifteen days from receipt thereof.

January 2026

Despite service of the legal notice, the Opposite Parties neither replied nor complied with the decree, thereby demonstrating wilful and deliberate disobedience.

2026

The Decree Holder constrained to file the present Execution Application under Sections 72 of the Consumer Protection Act, 2019 seeking execution, enforcement and penal action for willful non-compliance.
