AFFIDAVIT
I,
Sri
Sanjib Das, Son of Late Sankar Chandra Das, aged about _____years, by faith
Hindu, by Occupation – Business, residing at Block – E6, Tagore Park, Ward no.
107, South 24 Parganas, Kolkata – 700 039, West Bengal, the Decree
Holder/Applicant above named, do hereby solemnly affirm and state as follows;
1.
That
I am the Decree Holder/Applicant in the instant Execution Application and the
deponent herein. Being fully acquainted with the facts and circumstances of the
case, I am competent to swear this Affidavit of Service.
2.
That
my learned Advocate, under my instructions and on my behalf, caused to be
issued a Legal Communication dated ________ July, 2026 addressed to the
Judgment Debtors, namely:
(i)
M/s. Riverbank Developers Private Limited, having its office at 225C, A.J.C.
Bose Road, 4th Floor, Kolkata – 700020; and
(ii)
M/s. Riverbank Developers Private Limited, having its office at 227, A.J.C.
Bose Road, Block-B, 4th Floor, Kolkata – 700020,
intimating them about
the filing of an Application under Section 72 of the Consumer Protection Act,
2019 in connection with Execution Application No. 16 of 2026 arising out of Consumer
Complaint No. SC/19/CC/263/2020 before this Hon'ble Commission.

That
along with the said Legal Communication, a complete set of the following
documents was enclosed and served upon each of the Judgment Debtors:
a. Copy of the
Application filed under Section 72 of the Consumer Protection Act, 2019;
b. Copies of all
annexures, documents and enclosures relied upon in the said application;
4.
That
the aforesaid Legal Communication together with the complete set of enclosures
was duly dispatched to both the Judgment Debtors through Speed Post on ________ July, 2026 at
their respective office addresses as mentioned hereinabove.
5.
That
the Speed Post articles were accepted by the Postal Authorities in the ordinary
course of business and official Postal Receipts were duly issued in
acknowledgment of such booking.
6.
That
thereafter, I caused the status of the aforesaid postal articles to be verified
through the official tracking system of the Department of Posts and obtained
the Postal Track Reports relating to the said Speed Post articles.
7.
That
the Postal Track Reports disclose that the aforesaid Speed Post articles were
duly processed and transmitted by the Postal Department in accordance with law.
The said Track Reports constitute documentary evidence of dispatch and movement
of the postal articles sent to the Judgment Debtors.
8.
That
true copies of the following documents are annexed hereto and collectively
relied upon as proof of service:
Annexure-A
– Copy of the Legal Communication dated ________ July, 2026.
Annexure-B (Colly)
– Copies of the Postal Receipts evidencing dispatch of the Legal Communication
together with the Application under Section 72 of the Consumer Protection Act,
2019 and all annexures by Speed Post.
Annexure-C (Colly)
– Copies of the Postal Track Reports generated from the official website of the
Department of Posts showing the tracking particulars of the aforesaid Speed
Post articles.

That
by causing service of the aforesaid Legal Communication together with the
Application under Section 72 of the Consumer Protection Act, 2019 and all
annexures upon the Judgment Debtors, sufficient notice of the institution and
pendency of the said proceedings has been furnished to them in the interest of
fairness, transparency and observance of the principles of natural justice.

That
this Affidavit of Service is being affirmed and filed before this Hon'ble
Commission for recording that the Judgment Debtors have duly been served with
the aforesaid Legal Communication and the accompanying documents by Speed Post,
and for taking the same on record.
11.
That
the statements made hereinabove are true to my knowledge, derived from records
maintained by me and from the official postal documents annexed hereto, all of
which I believe to be true and correct.

deponent, do hereby verify that the statements contained in paragraphs 1 to 11
hereinabove are true and correct to my knowledge and belief, no part thereof is
false and nothing material has been concealed therefrom.
