Subject: Intimation regarding illegal and
unauthorized occupation of private property by Sarsuna Khudiram Pally Samaj
Kalyan Samity, A-31,
Khudiram Pally, Talpukur Road, P.S. Thakurpukur, Sarsuna, Kolkata – 700061, and request for preventive
police intervention to maintain law and order.
Respected Sir,
Under the instructions and on
behalf of my clients, namely (1) Miss Kanika Sarkar,
daughter of Late Dhirendra Nath Sarkar and Late Smt. Mira Rani Sarkar; and (2) Smt. Anamika Ramudamu,
wife of Sri Dhanlal Ramudamu, daughter of Late Dhirendra Nath Sarkar and Late
Smt. Mira Rani Sarkar, both residing at Mira
Apartment, Premises No. 50, Bidhu Bhusan Sengupta Road, P.S. Parnasree
(formerly Behala), Kolkata – 700034, I respectfully submit this
letter for your kind information and necessary preventive action;
1.
That
my clients are the absolute joint owners and lawful successors in interest of a
piece and parcel of land measuring 67.89
(Sixty-Seven Decimal Eight Nine) Decimals, lying and situated
at Mouza –
Paschim Barisha, comprised in C.S., R.S. and L.R. Dag No. 1022,
under C.S./R.S.
Khatian No. 2295 corresponding to L.R. Khatian No. 3185,
situated at Talpukur Road, Khudiram Pally, within the jurisdiction of Sarsuna
Police Station.

That
the aforesaid property originally belonged to their mother, Late Smt. Mira Rani Sarkar @
Mira Sarkar, who was the recorded owner and was in peaceful
possession and enjoyment thereof during her lifetime. She expired intestate on 21st August, 1994,
leaving behind only the aforesaid two daughters as her sole legal heirs and
successors. Consequently, by operation of the provisions of the Hindu
Succession Act, my clients have inherited and become the absolute owners of the
said property.

That
despite the lawful ownership of my clients, it has come to their knowledge that
Sarsuna Khudiram
Pally Samaj Kalyan Samity, having its office at A-31, Khudiram
Pally, Talpukur Road, P.S. Thakurpukur, Sarsuna, Kolkata – 700061, has been
occupying and using a substantial portion of the aforesaid land without any
lawful authority, title, lease, licence, permission or consent from my clients
or from their predecessor-in-interest.

That
the occupation of the said property by the aforesaid Samity is entirely
unauthorized, illegal and without any legal sanction. My clients have never
transferred, sold, leased, licensed or otherwise permitted the said Samity to
enter into or continue in possession of the property. Accordingly, the
continued occupation amounts to wrongful possession and interference with the
valuable proprietary rights of my clients.
5.
That
my clients have already caused a legal notice to be issued upon the office
bearers of the said Samity calling upon them to vacate the property and to hand
over peaceful, vacant and khas possession of the land within the stipulated
period. However, my clients have reliable information that instead of complying
with the lawful demand, certain members and supporters of the Samity may
attempt to create disturbance, resist lawful steps, assemble unlawfully or
otherwise obstruct my clients from asserting their legal rights over the property.

That
my clients are peace-loving and law-abiding citizens. They have no intention
whatsoever of taking the law into their own hands or creating any breach of
public peace. They intend to pursue their legal remedies strictly in accordance
with law before the competent court. Nevertheless, they reasonably apprehend
that the unauthorized occupants or their associates may indulge in acts capable
of disturbing public order, causing intimidation, obstruction or other untoward
incidents.

In
these circumstances, this communication is being submitted as a preventive intimation
so that the police authorities are apprised of the existing dispute and may
maintain constant vigilance over the locality. It is requested that appropriate
preventive measures be taken in accordance with law to ensure that no breach of
peace, unlawful assembly, intimidation, criminal trespass, damage to property
or other cognizable offence is committed by any person in relation to the
aforesaid property.

It
is further requested that if any information is received regarding any attempt
to raise fresh construction, alter the nature and character of the property,
dispossess my clients, create third-party rights or commit any act likely to
result in a law-and-order problem, your office may kindly take prompt
preventive action in accordance with law to preserve peace and prevent
escalation of the dispute.

This
representation is being made solely with a view to maintaining public order and
ensuring that no untoward incident takes place. My clients reserve their rights
to institute appropriate civil and criminal proceedings before the competent
forums against all persons responsible for the unauthorized occupation and any
subsequent illegal acts committed in respect of the aforesaid property.
10.
You
are, therefore, requested to kindly acknowledge this intimation, keep the same
on record, make the necessary General Diary entry, if deemed appropriate, and
extend such preventive police assistance as may be permissible under law for
maintaining peace, tranquillity and public order.
This representation is
submitted without prejudice to all the legal and equitable rights, claims and
remedies available to my clients under the applicable laws, all of which are
expressly reserved.
